Brothers, Inc. in the amount of $2,260,934.00 for the Roosevelt Avenue Streetscape-Phase I Improvements; and WHEREAS, the Borough's Consulting Engineer for the project, CME Associates, has advis~d the Goveming Body that a modification of the contract is reasonable and necessary and has recommended that the aforesaid contract be modified in accordance with Contract Change Order #2 (see attached); and WHEREAS, Change Order # 2 includes a change in the scope of the contract work to include additional and supplementary work ordered and required to perform the required streetscape work and storm sewer installation to improve service to the Borough and satisfactorily complete the work; and WHEREAS, Change Order #2 provides for a net reduction in the contract price in the amount of$337.30, resulting in a revised contract price of$2,360,452.70 including all previously approved change orders; and WHEREAS, the Borough's Consulting Engineer, CME Associates has advised that the above described changes and/or modifications to the project were unforeseen at the time of the award of the original contract. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Carteret as follows: 1. That the Contract Change Order #2 attached hereto and made a part hereof, resulting in a net reduction of$337.30, and resulting in a revised contract price of $2,360,452.70 is hereby approved. 2. That the appropriate Borough Officials are hereby authorized to execute Change Order #2 based upon the recommendation of the Borough Engineer. 3. That the Borough Purchasing Depal1ment is hereby authorized to issue any payment on the above described contract pursuant to Payment Certification No.2 (see attached). 4. A copy of this resolution and a fully executed copy of Change Order #2 be forwarded to CME Associates for disl1ibution to S. Brothers, Inc.
