HomeMy Public PortalAboutResolution 19-94 Overtime for PW and PD RESOLUTION NO. 19-94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, IDAHO, DECLARING AN EMERGENCY; AUTHORIZING ADDITIONAL OVERTIME PAY FOR THE POLICE AND PUBLIC WORKS DEPARTMENTS TO SAFEGUARD LIFE,HEALTH AND SAFETY OF THE COMMUNITY, ITS RESIDENTS AND VISITORS AND PROPERTY THEREOF, ORDERING THE EXPENDITURE OF FUNDS THEREFOR, ORDERING THE BORROWING OF SUCH FUNDS, ORDERING THAT A TAX LEVY BE IMPOSED TO PROVIDE FOR REPAYMENT OF SUCH FUNDS AND INTEREST,AND PROVIDING AN EFFECTIVE DATE. WHEREAS the crime rate, accident rate, and other demands for public safety service in McCall during 1994 to date has been 160% of that for the prior year to the same date, and crimes are occuring that there are no funds to investigate,all of which creates a need for unanticipated ordinary and necessary expenditures; WHEREAS the Police Department has already exhausted its overtime budget appropriation; and the Police Department needs to hire 2 additional patrolmen to manage this volume of work without overstressing the present officers, and thus the Police Department will also exhaust its payroll appropriation prior to the end of the fiscal year by reason of these casualties, and the Community's safety is at risk; WHEREAS the Department of Public Works has experienced snow removal fuel costs greatly in excess of those anticpated by the budget, and has suffered equipment deterioration making replacement of parts critical to avoid risk of serious personal injuries, the Department will also exhaust its appropriation prior to the end of the fiscal year by reason of these casualties, and the Community's safety is at risk through sharp reduction in street,potable water, sanitary sewer,and park maintenance work; BE IT RESOLVED by the Mayor and Council of the City of McCall that: Section 1. The Mayor and Council declare pursuant to 50-341(L),IC 50-1006, and IC 50-1018 that the public interest and necessity demand the immediate expenditure of public money for the the meeting of payroll in order to safeguard life, health and property through continuing the activities of the Police Department. Section 2. The Mayor and Council declare an emergency pursuant to 50-341(L) and IC 50-1006 by reason of such unanticipated fuel and maintenance expenses, and that the public interest and necessity demand the immediate expenditure of public money for the meeting of payroll in order to safeguard life, health and property under IC 50-1018 and 50-341(L) through continued activities of the Public Works Department. Section 3. The Mayor and Council are authorized,to borrow $10,000 for the use of the Police Department, and$40,000 for the use of the Public Works Department, and to issue warrants to West One Bank in such amounts,bearing interest not to exceed 5.24%. Section 4. Such sums and interest shall be added to the amount authorized to be raised in the general tax levy for fiscal 1995, and embraced therein,in the amount of$50,000 principal plus an amount of interest estimated to be$1,965. Section 5. This Resolution shall be in full force and effect immediately upon its adoption and approval.
