RESOLUTION NO. 13-94
A RESOLUTION OF THE CITY OF McCALL, IDAHO, INITIATING THE FORMATION
OF LOCAL IMPROVEMENT DISTRICT NO. 5; DESCRIBING THE IMPROVEMENTS TO
BE CONSTRUCTED, THE PROPOSED BOUNDARIES, AND THE PROPERTY TO BE
ASSESSED, IN THE PROPOSED IMPROVEMENT DISTRICT; AND PROVIDING FOR
OTHER RELATED MATTERS
WHEREAS, the City of McCall, Valley County, Idaho (the
"City") , is a municipal corporation organized and operating under
the laws of the State of Idaho and is authorized to create local
improvement districts for public improvements pursuant to Title 50,
Chapter 17, Idaho Code; and
WHEREAS, the City Council (the "Council" ) of the City has
determined to initiate the formation of a local improvement
district for the purposes described hereinbelow.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF McCALL, IDAHO, as follows :
Section 1 : Pursuant to Idaho Code Section 50-1706, the
formation of a local improvement district, to be known and
r designated as City of McCall Local Improvement District No. 5
("L. I .D. No. 5") is hereby initiated.
Section 2 : The proposed improvements to be constructed within
L. I .D. No. 5 consist generally of the installation of domestic
water service improvements, including water mains, valves,
hydrants, and connections, and sanitary sewer service improvements,
including sewer mains, pressure lines, connections, and lift
station, together with related improvements and costs of
engineering, legal services, publication, interest on borrowed
funds during construction, bond issuance costs and reserves, and
other related expenses (the "Improvements") .
Section 3 : A general description of the boundaries of L. I .D.
No. 5 and of the properties proposed to be assessed for the cost of
the Improvements is annexed hereto as Exhibit "A" and by this
reference incorporated herein.
Section 4 : The assessable portion of the costs and expenses
of the Improvements shall be assessed against the tracts, lots, and
lands benefited by the Improvements according to combination of the
front-foot and square-foot methods of assessment, as provided by
Section 50-1707, Idaho Code.

Section 5 : This resolution shall take effect and be in force
immediately upon its passage and approval .

DESCRIPTION OF HIGHWAY 55 Lill BOUNDARY
A portion of the SW 1/4 SE 1/4 of Section 16, T. 18N., R.3L•, B.M., City of McCall,
Valley County, Idaho, being described as follows: BEGINNING at the point of intersection
of the easterly rig11:•of way line of State Highway No. 55 with the southerly sideline of
Jacobs Street; thence,
1) S.89°37'41" E., 342.80 feet along the southerly sideline of Jacobs Street, being along
• the northerly lines of Gabel and Payette Lakes Water and Sewer to the northwesterly
corner of said Payette Lakes Water and Sewer; thence
2) S.17°50'30" E.. 342.80 feet along the easterly tine of lands of Payette Lakes Water
and Sewer, Acheson, Swain and Jones: thence,
3) S.15927'56" 13., 594.91 feet along the easterly lino of Spradling and the easterlyline
of Spradling and Johnson to a point on the northerly sideline of Krahn Lane; thence
4) S.89`23'23" W., 344.04 feet along the southerly line of Spradling and Johnson, being
the northerly line of said Krahn Lane to the point of intersection of same with the
easterly right-of-way line of said State Highway No. 55; thence,
5) N.16°43'13" W., 1297.09 feet along said easterly right-of--way line, being along the
