RESOLUTION NO.'76 117
RESOLUTION APPROVING ENTERPRISE PROPERTIES' LAND DIVISION
Whereas, Enterprise Properties is proposing to divide the following described land:
"The South thirty (30) acres of the South one-half (S poi. the Northwest quarter (NW i)
of Section One, Township 118;iā¢Range 23, West of the 5th Princinal Meridian, excepting
therefrom the West 534 feet of the South 217.5 feet, according to the U. S. government
survey thereof, subject to easement of the public in the West 33 feet thereof for County
Road 1167; into 5 parcels for residential development; and
Whereas, soil investigations of the tract and a subsequent soil overlay executed by
the Hennepin County Soil and Water Conservation District, now on file with the City of
Medina, have revealed that the soils found on the tract, namely Dundas silt loam, Dalbo
silt loam, and Nessel loam, are unsuited for conventional on -site soil absorption sewage
disposal systems now permitted and required under Medina's Sewage Disposal Code, and
Whereas, the report issued by the Henn. Conservation District for this tract recom-
mends that development be permitted only in conjunction with installation of innovative
mound systems for sewage disposal as described in the model ordinance distributed by the
Henn. Conservation Dist. entitled "Sewage Disposal and Soil Treatment with Individual
Systems", and
Whereas, the said model ordinance recommends in Section 12 that Nessel loam soils
require an innovative shallow trench subsurface system with standards set forth in
Section 17, and that Dundas silt loam and Dalbo di t loam soils require the innovative
mound system h1, with standards set forth in Section 18 and Appendix I, and
Whereas, such systems cannot be constructed in Medina except by variance,
Now, therfore, be it resolved that the City Council of the City of Medina hereby
approves the division of the aforementioned tract into 5 parcels as described herein,
and grants the necessary variances for construction of innovative :sewage disposal systems,
as set forth herein, subject to the following conditions:
That parcel A, described as follets: "That part of the South 30 acres of the Northwest
Warter of .-section 1, Township 118 North, Range 23 West, Hennepin County, Minn; lying West
of the Fast 1760 feet, except the West 534 feet of the .youth 217.5 feat thereof. ;subject
to a, roadway easement over. the West 40 feet thereof;';
And parcel B, described as follows:"The West 440 feat of the blast 1760 feet of the
South 30 acres of the Northwest quarter of Section 1, Township_ 118 North, Range 23 west,
Hennepin County, Minn.; containing 5 acres.";
Containing Dundas silt loam and Dalbo silt loam soils shall be developed only with an
innovative mound system for sewage disposal according to standards meeting or exceeding
those set forth in Section 18 and Appendix I of the aforementioned model ordinance,
"Sewage Disposal and Soil Treatment with Individual Systems" (1976)
That Parcel D, described as follows: "The West 440 feet of the Last 880 feet of the
South 30 acres of the Northwest quarter of Section 1, Township 118 North, Range 23 West,
Hennepin County, Minn.; containing 5 acres." containing mostly Nessel loam soil, shall
be developed only with an innovative shallow trench subsurface sewage disposal system
with standards meeting or exceeding those set forth in Section 17 of the aforementioned
model ordinance.

That parcel C, described as follows: "The West 440 feet of the East 1320 feet of
,he South 30 acres of the Northwest 'quarter of Section 1, Township 118 North, Range 23
Zest, Hennepin County, Minn. containing 5 acres."
And parcel E, described as follows: "The east 440 feet of the South 30 acres of the
Northwest Quarter of Section 1, Township 118 North, Range 23 latest, Hennepin County, Minn.
containing 5 acres." found to contain Nessel loam and Dundas silt loam, shall be developed
only with an innovative mound system as required for parcels A and B, subject to the same
standards,; or may be developed with an innovative shallow trench system as permitted on
parcel D, subject to the same standards, if such system is located entirely within the
boundaries of the Nessel loam soil on each parcel as shown on the soil overlay on file
with the City of Medina.
In addition to the preceding stipulations, development on any of the lots previously
described shall be subject to the following additional conditions:
Before a building permit is issued, the applicant shall submit a plan to the City
of Medina showing the following information;
1. Location of the system on the lot.
2. Plans and specifications for the sewage disposal system, designed by a regis-
tered engineer.
3. Name and address of the person doing the installing of such system.
Such plans shall be approved by the City Engineer before construction may begin.
Actual installation of such system shall be supervised by a registered engineer and
'ity inspection of such installation shall be performed by the City Engineer with expenses
o be borne by the applicant.

The motion for the adoption of the foregoing resolution was duly seconded by member
Arthur Theis and upon vote being tnken thereon, the following voted
in favor of: Neddermeyer, Theis, FrnnF Fin,. DesL::.uriers, Reiser
and the following voted against the same: none
whereupon said resolution was declared duly passed and adopted.
