HomeMy Public PortalAboutResolution 06-94 Dedicating Land to Parks and Recreation RESOLUTION NO. 6-94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, IDAHO, DEDICATING CERTAIN LAND TO PARK AND RECREATION USE. WHEREAS 1. The City has acquired certain real property expressly for park and recreation use; and 2. The City has an obligation in connection with the Land and Water Conservation Fund with respect to these lands; BE IT RESOLVED by the Mayor and Council of the City of McCall that: Section 1. The land described on Exhibit"A" to this Resolution is dedicated by the City to park and recreation uses in perpetuity. Section 2. This resolution shall be considered both offer and acceptance of dedication, and be effective immediately upon its passage. Passed and approved April 14 1994. S"hmidt, City Clerk Resolution 6-94. page 1 of 1 Printed April 11, 1994 Exhibit"A" PARCEL ONE: A tract of land one hundred (100) feet wide, being fifty (50) feet each side of the centerline of what was the main track of the Idaho Northern Line of the Oregon Short Line Railroad, as the same was located over and across the Southwest Quarter of the Northwest Quarter (SW 1/4 NW 1/4) of Section 16, T. 18 N., R. 3 E., B. M., Valley County, Idaho, such centerline being more specifically described as follows: Beginning at a point in the south section line of such Section 16, which point is located seven hundred fifty-one feet east of the southwest corner of such Section 16; Thence northerly along a spiraled curve to the left with a radius of 1,146.3 feet, for a distance of 327.9 feet; Thence N. 2° 28' W. a distance of 2320.00 feet, more or less, to a point on the east-west centerline of such Section 16 (the south line of the SW 1/4 NW 1/4); the Real Point of Beginning; Thence continuing N. 2° 28' W. a distance of 1320 feet, more or less, to a point in the north 1/16th line of such Section 16 (the north line of the SW 1/4 NW 1/4) which point is located 650 feet, more or less, east of the west section line of such Section 16; Containing 3.03 acres, more or less. ALSO, PARCEL TWO: A tract of land 100 feet wide (except 50 feet wide with respect to that portion thereof lying north of the north right-of-way line of Stibnite Street), being 50 feet (except 25 feet with respect to that portion thereof lying north of the north right-of-way line of Stibnite Street) each side of the centerline of what was the main track of the Idaho Northern Line of the Oregon Short Line Railroad, as the same was located over and across the Northwest Quarter of the Northwest Quarter (NW 1/4 NW 1/4) of Section 16, T. 18 N., R. 3 E., B. M., Valley County, Idaho, such centerline being more specifically described as follows: Beginning at the Real Point of Beginning, a point in the north section line of Section 16, T. 18 N., R. 3 E., B. M., located 680 feet, more or less, east of the northwest corner of such Section 16; Thence southerly along a spiraled curve to the left with a radius of 1432.7 feet a distance of 618.9 feet; Thence S. 2° 28' E. a distance of 712 feet, more or less, to a point in the north 1/16 line of such Section 16 (the south line of such NW 1/4 NW 1/4), which point is located 650 feet, more or less, east of the west section line of such Section 16, and which point is the same point as that described above on such 1/16th line in the description of Parcel One; Containing 3.05 acres, more or less, less the area difference resulting from the reduction in width north of Stibnite Avenue from 100 feet to 50 feet. Contained in total, therefore 6.08 acres more or less, less the area difference resulting from the reduction in width north of Stibnite Avenue from 100 feet to 50 feet.. SAVE AND EXCEPT an eighty foot wide right-of-way for Deinhard Lane centered on the centerline thereof, and further SAVE AND EXCEPT a sixty foot wide right-of-way for Stibnite Street, centered on the centerline thereof.
