HomeMy Public PortalAboutResolution 02-94 Suspension of the open container restriction for Winter Carnival RESOLUTION NO.,A. -94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF McCALL, IDAHO, AUTHORIZING A CATERING PERMIT AND SUPSENSION OF THE OPEN CONTAINER RESTRICTION FOR SPECIFIED TIMES AND LOCATIONS. WHEREAS 1. The McCall Chamber of Commerce is again sponsoring Winter Carnival; 2. The McCall Chamber of Commerce is planning a food court on the old railroad right-of-way and wishes to sponsor a beer court within the same; and 3. The Council finds a temporary and limited suspension of the open container law would be in the public interest and would further McCall's economic well-being or development; and that the Chamber is an exempt nonprofit organization; BE IT RESOLVED by the Mayor and Council of the City of McCall that: Section 1. The following described area within that portion of the old railroad right-of- way denoted by the City as the Depot Road, is authorized as a food court where a person may have an open container of an alcoholic beverage during the times that the food court and the Chamber's information office are open during Winter Carnival 1994,provided that the Police Chief may order such beer court to be closed, and such suspension of the open container law at an end, in the event the Chamber fails to confine the consumption of beer to the food court: the area bounded on the Southwest by and not including the Chamber's then information booth to be located near Highway 55 but east of the City parking lot, on the Northeast by and not including the Chamber's entrance to the State Ice Sculpture Contest near the easterly edge of the Depot building, and on the Northwest and Southeast by the side limits of the roadway as cleared of snow. Beverages purchased within or brought into the food court area must be consumed within the food court area. Section 2. This resolution shall be effective upon the last to occur of: the publication of ordinance number 658; the obtaining of catering permit(s) or Section 23- 1007(A)(2)permit(s)for this activity, but only while that permit(s) is in force and being exercised at the food court; and the furnishing to the City Clerk of a certificate of insurance naming the City as an additional insured with a combined single limit of at least$500,000 and not exceeding$1,000,000, such amount being subject to the discretion of the Clerk.
