HomeMy Public PortalAbout1999.145 (09-07-99)RESOLUTION NO.99.145 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD URGING THE CALIFORNIA REGIONAL WATER QUALITY CONTROL BOARD, LOS ANGELES REGION, NOT TO IMPOSE NUMERIC LIMBS ON THE TREATMENT OR RETENTION OF STORM WATER RUNOFF FROM NEW DEVELOPMENTS PURSUANT TO THE LOS ANGELES COUNTY MUNICIPAL NPDES PERMIT ' WHEREAS, the California Regional Water Quality Control Board, Los Angeles k~ Region (hereinafter "regional. board") is considering the incorporation ~of numeric limits into the Standard Urban Storm Water Runoff Mitigation Plan component of the model development planning program - a requirement associated with the Los Angeles County Municipal NPDES permit (hereinafter, "municipal NPDES permit"); and WHEREAS, such numeric limits are intended to retain or treat storm water runoff volume (either .60" or .75" of :rain) from 7 categories of new development projects, including gas stations, restaurants, auto repair facilities, 10-99 housing sub-divisions, 100-plus housing sub-divisions, single-family hillside homes, and 100,000 square foot commercial developments; and . WHEREAS, meeting'the proposed numeric limits would necessitate the imposition of structural controls on new developments, including but not limited to extended detention basins, wet ponds, infiltration basins/ponds (which reduce the amount of developable space), storm drain-connected oiUgrit separators, catch basin inserts, grassy swales, and other devices, many of which have not been proven to be cost-effective; and WHEREAS, such structural controls would require post-construction operation and maintenance,. which cities would be required to enforce; and WHEREAS, such controls, if not properly designed or maintained, could become sources of pollution rather than pollution mitigants; and WHEREAS, storm water treatment'and retention. numeric limits are not specifically mandated in the municipal NPDES permit and are not a requirement associated with other municipal NPDES permits issued in the State of California; and WHEREAS, neither the regional board nor any other interested party has provided compelling justfication for the use of numeric limits for treating or retaining storm water runoff from new developments; and WHEREAS, neither the regional board.nor any other interest party has demonstrated that storm-water retention/treatment numeric limits would result in the improvement or protection of a beneficial use of a receiving water, and WHEREAS, imposing such unproven and questionable numeric limits on cities constitutes an unfunded state mandate, one that has not been evaluated in cost- effective terms, as required by state law. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF LYNWOOD, STATE OF CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: . . SECTION 1.' That the City Council opposes storm water treatrnenUretention numeric limits. SECTION 2. That the City Council recommends that the regional board approve the Standard Urban Storm Water Mitigation Ptan, which does not include numeric limits, as proposed by the Executive Advisory; Committee on August 11, 1999. SECTION 3. That the City Clerk is directed to send a certfied copy of this resolution to the Dennis Dickerson, Executive Officer, California Water Quality Control- Board, Los Angeles Region, 320 West 4"' Street, Ste 200, LA. CA 90013. SECTION 4. That this resolution shall take effect immediately upon its adoption.
