CITY OF MEDINA
RESOLUTION NO. 77-5
RESOLUTION EXCEPTING LOUIS J. HAMMERSCHMIDT
CONSOLIDATION
WHEREAS, Louis J. Hammerschmidt, unmarried, is the owner of
real estate described as Lots 9 and 10, Block 20, Independence Beach,
Hennepin County, said property being two separate parcels of record prior
to the 16th day of March, 1976; and
WHEREAS, the said owner has made application to consolidate
the property as follows:
Parcel 1: Lots 9 and 10, Block 20, Independence Beach;
WHEREAS, the proposed consolidated parcels are served by public
sanitary sewer and water and the owner has requested a fair consolidation
of special assessments heretofor levied; and
WHEREAS, none of said property has previously been the subject of
a division or consolidation under this ordinance; and
WHEREAS, the proposed consolidation will not require additional
streets; and
WHEREAS, a survey of the property, a sketch of the proposed consoli-
dation and a concise legal description have been filed as part of the application;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Medina as follows:
(1) That the said consolidations are excepted from the
Platting Code,
(2) Variances are granted from the lot width requirements
and the area requirements of the Medina Zoning Ordinance,
to the extent required by the plans submitted;
(3) A practical difficulty exists in that the original surveys of
Independence Beach contain ambiguities and uncertainties
making it impossible to reconcile the survey lines with the
lot lines established by long usage, and the unusual size
and topography of the lots create a hardship when the
ordinance setbacks are imposed;
(4) Existing special assessments for public improvements shall
be assigned 100% thereof to Parcel 1.
PROVIDED HOWEVER % tnatAhe applicant fulfill the following
conditions:
(1) Obtain a Land Combinatiotrom the Hennepin County Finance
Department consistent herewith.

PROVIDED FURTHER that no construction permits be issued for the
property until compliance with the foregoing conditions has been demonstrated.,
and that fee for combination be waived by the City.

The motion for the adoption of the foregoing resolution was duly seconded
by member William Reiser and upon vote being taken thereon, the
following voted in favor of: Reisex. Theis, lveddermeyer, Crosby, Laurent
and the following voted against the same: none
whereupon said resolution was declared duly passed and adopted.
