and moved its adoption:
CITY OF MEDINA
RESOLUTION NO. 77-12
RESOLUTION APPROVING EXPENSES OF THE COLONIAL
DRIVE-IN THEATRE HAZARD OUS STRUCTURE
WHEREAS, the City of Medina notified the Colonial Drive -In
Theatre in August of 1976 to remove a hazardous structure (abandoned
septic system) from its premises; and
WHEREAS, the City authorized and directed the City Attorney to
proceed with a Hazardous Building condemnation of the said str ucture
in September of 1976; and
WHEREAS, such action proceeded from December of 1976 through
March of 1977; and
WHEREAS, the removal of the hazardous structure was completed
on March 25, 1977 by Metro Engineering Company and approved by the
City Engineer; and
WHEREAS, the City incurred certain administrative expenses in
connection with the removal of the structure which are compensable under
§463.22 of Minnesota Statutes, an itemized listing of such expenses being
attached hereto and made a part hereof by reference.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina, that the expenses as presented by the City Attorney are
hereby approved;
BE IT FURTHER RESOLVED that the City Clerk is hereby directed
to notify the Colonial Drive -In Theatre of the expenses and requests payment
thereof;
BE IT FURTHER RESOLVED that if payment is not received on or
before October 1, 1977, that the City Clerk is hereby authorized and directed
to certify said amount to the Auditor of Hennepin County for entry on the tax
lists of the County as a special charge against the real estate of Colonial
Drive -In Theatre Company, to be collected with other taxes and paid over
into the municipal treasury.

The motion for the adoption of the foregoing resolution was duly seconded
by member Arthur Theis and upon vote being taken thereon, the
following voted in favor of:
Theis, Crosby, Laurent, Reiser, Neddermeyer
and the following voted against the same:
none
whereupon said resolution was declared duly passed and adopted.

RE: COLONIAL DRIVE-IN HAZARDOUS BUILDING EXPENSES
§463.22 of Minnesota Statutes provides that in cases where the City
is required to proceed against the owners of a hazardous structure under
the Hazardous Building Statute, the City may recover its administrative
expenses, by notifying the property owner and requesting payment. If
payment is not received by October 1, of the year in which the owner
is so notified, such amount may be certified to the County Auditor for
collection as a special assessment.
The expenses incurred by the City of Medina in obtaining the removal
of the hazardous structure (abandoned septic system) at the Colonial Drive -
