CITY COUNCIL
MINUTES
JULY 6, 1976
INITIATION:
1. Mayor Greenberg called the regular meeting of the City Council to
order at 7 :30 p.m. on Tuesday, July 6, 1976, in the Council Chamber
of the City Hall.
2. The invocation was given by Reverend David Willett, Temple City
Grace Brethren Church, 5537 N. Temple City Boulevard.
3. The Pledge of Allegiance-to the Flag was led by Mayor Greenberg.
4. ROLL CALL:
Present: Councilmen- Gilbertson, Merritt, Tyrell, Greenberg
Absent: Councilmen- Dennis
Also Present: City Manager Koski, City Attorney Martin, Assistant
City Manager Biel, Director of Parks and Recreation
Kobett, Planning Director Dragicevich
Councilman Gilbertson moved to excuse Councilman Dennis for cause,
seconded by Councilman Merritt and carried.
5. APPROVAL OF MINUTES:
Councilman Gilbertson moved-to approve the minutes of the regular
meeting of the City Council held on June 15, 1976, as written,
seconded by Councilman'Merritt and carried.

6. CONTINUED PUBLIC HEARING: 7 :30 p.m. AMENDMENT TO ZONING CODE RE:
NOISE STANDARDS AND REGULATIONS
City Manager Koski provided background information, stating City
Council, at their regular meeting held June 1, 1976 held Public
Hearing on the. proposed Noise Ordinance and referred the matter
back to the Planning ,Commission to review new draft which included
subjective and objective: criteria-prepared by the City Attorney at
Council's request: Planning: Commission, at their regular meeting
held June 22, 1976 recommended- the new draft be approved by the
City Council.
Mayor Greenberg :stated .the new draft was much more complicated than
he had anticipated -'and :felt it might be difficult to enforce; that
he personally ` would ~like .to spend more time in the field to ascertain
the recommended noise levels as opposed to the existing noise levels,
to be followed by a study session with the Planning Commission.

Councilman Tyrell moved- to continue the public hearing to Tuesday,
August 3, 1976 and set joint study session with the Planning Com-
mission Monday, July 19, 1976, seconded by Councilman Merritt and
carried.
7. SET PUBLIC HEARING: ASSESSMENTS FOR STREET IMPROVEMENTS - INSTALLATION
OF SIX 7,000 LUMEN LIGHTS, NADINE STREET, 9800 -9900 BLOCK (Pursuant
to Chapter 27, Streets and Highways Code)
City Manager Koski presented background information, stating the City
Council, at their regular meeting held March 16, 1976, authorized

the installation.of six 7,000 lumen street lights within subject
limits pursuant to Chapter 27, Streets.and Highways Code. Instal-
lation has been completed; the cost of the installation to be spread
among 33 property-owners,-cost of energy and maintenance among 32 as
one property-owner is.presently :in Zone A. Mr. Koski presented two
options for assessment, one being on a front footage basis, the other
based on an equal amount per parcel.
Councilman Giiber.tson :moved to accept the installation and set
public hearing._for July 20., 1976 to approve assessment and instruct
the Superintendent-of-Streets to notify the property owners, advising
them -of the-two assessment methods, seconded by Councilman Tyrell
and carried.
8. AMENDMENT TO CETA, TITLE II SUB - AGREEMENT - For Period July 1, 1976
to January 31, 1977
City Manager Koski advised funding has been provided under Title II
of the Comprehensive Employment and Training Act and, therefore,
, the County has provided for extension of the Sub - Agreement through
January 31, 1977 in a total amount of $74,710.
Councilman Tyrell moved to approve the Sub - Agreement and authorize
the Mayor to sign, seconded by Councilman Merritt and carried.
NEW BUSINESS:
9. RECOMMENDATIONS FROM PLANNING COMMISSION -
A. AMENDMENT TO ZONING CODE RE: RETIREMENT HOMES IN RESIDENTIAL
AREAS
City Manager Koski presented background information, stating the
Planning Commission-reviewed Section 9202, Conditional Use Permits
which - allows "Homes for the aged" under a conditional use permit
category, in multiple residential zones as well as in commercial
zones, and at-their regular meeting held June 22, 1976, adopted
Resolution No. 76 -697PC redefining the category to include "institu-
tional care in R -3. and R -4 zones" and allow non - institutional,
retirement residences in any residential zone including R -1 and
R -2 zones.
Councilman Gilbertson = moved to set public hearing relating to
Planning Commission Resolution No. 76- 697PC for July 20, 1976,
seconded by Councilman Tyrell and carried.
B. CHANGE OF ZONE FROM R-2 TO R -3: 5127 -29 Sultana Avenue and
5122 -24 Rosemead Boulevard
City Manager Koski background information, stating the
Planning Commsision.at their regular meeting held May 25, 1976,
approved Tentative Parcel Map No. 6804 dividing subject property
into three parcels, which division resulted in two zones existing
on one property, a strip of land 5' x 100' located _250 ft. easterly
of Rosemead Boulevard, At their regular meeting held June 22, 1976,
Planning Commission adopted Resolution No. 76 -698PC recommending a
change of zone for this strip of land from R -2 to R -3.
Councilman-Tyrell moved to set public hearing relating to Planning
Commission Resolution No. 76 -698PC for July 20, 1976, seconded by
Councilman Gilbertson and carried.
10. RECOMMENDATION FROM PARKS AND RECREATION COMMISSION -
A. INSTALLATION OF COIN METERS AT LIVE OAK PARK TENNIS COURTS
City Manager Koski presented background :information, stating the
City Council, at their study session held May 3, 1976, reviewed a

report from staff regarding the installation of coin meters on
the tennis courts lights at Live Oak Park and referred the matter
to the Parks and Recreation Commission for a recommendation. At
their regular meeting held June 21, 1976, Parks and Recreation Com-
mission recommended that meters be installed and the light charge
be set at 25 cents for 30 minutes of light at a cost of $500.
Following brief discussion regarding the annual cost of lighting
the tennis courts, the conservation of energy which could result
from the installation of meters., and the fact that those utilizing
the-services would help defray the cost of that service, Councilman
Merritt moved to approve the installation of coin meters on the
tennis courts at Live Oak Park and that the meters be set to provide
30 minutes of light for 25 cents,- seconded by Mayor Greenberg and
carried.
11. RESURFACING PROJECT - FY 1976 -77 LAS TUNAS DRIVE FROM THE EASTERLY
TO WESTERLY CITY LIMITS
City Manager Koski advised that the City Council had appropriated
funds in the 1976 -77 budget for the resurfacing of Las Tunas Drive
from the easterly to westerly city limits. The contract price for
the resurfacing is estimated to be $125,000, cost for preparation
of plans and specifications, field inspection, etc. estimated to
be $5,000.
Councilman Merritt moved to approve the plans and specifications
and authorize advertising and receiving of bids, and approve the
calendar of events as set forth in memo dated June 30, 1976 and on
file in the City Clerks office, seconded by Councilman Gilbertson
and carried.
12 RESOLUTION NO. 76 -1559: ADOPTING SALARY SCHEDULE AND PAY PLAN
Councilman Gilbertson moved to adopt Resolution No. 76 -1559 A
RESOLUTION OF THE CITY COUNCIL. OF THE CITY OF TEMPLE CITY ADOPTING
A SALARY SCHEDULE AND PAY PLAN, seconded by Councilman Tyrell and
carried.
13. RESOLUTION NO. 76 -1560: ADOPTING SALARY SCHEDULE AND PAY PLAN
FOR CETA PERSONNEL
Councilman Merritt.moved-to adopt Resolution No. 76 -1560 A RESOLUTION
OF THE CITY COUNCIL. OF THE: CITY. OF TEMPLE CITY ADOPTING A SALARY
SCHEDULE AND PAY PLAN FOR CETA PERSONNEL seconded by Councilman
Gilbertson and carried.
14. RESOLUTION NO. 76 -1561: ESTABLISHING HOLIDAYS
Councilman Gilbertson moved to adopt Resolution No. 76 -1561 A
RESOLUTION OF THE CITY. COUNCIL: OF THE CITY OF TEMPLE CITY ES-
TABLISHING HOLIDAYS, seconded by Councilman Merritt and carried.
15. RESOLUTION NO. 76 -1562: EMPLOYMENT OF PERSONNEL
Councilman Gilbertson moved to adopt Resolution No. 76 -1562 A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING
PERSONNEL, seconded by Councilman Merritt and carried.
16. RESOLUTION NO. 76 -1563: WARRANTS & DEMANDS, Demand Nos. 4527 thru
4629 in the amount of $199,284.60
Councilman Merritt moved to adopt Resolution No. 76 -1563 A RESOLUTION
OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND
DEMANDS IN THE SUM OF $199,284.60, DEMAND NOS. 4527 THRU 4629,
seconded by Councilman Gilbertson and carried, Mayor Greenberg noting
his non- participation with respect to check #4590.
17. COMMUNICATIONS:

18. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:
Mrs. Marianne Milch, Temple City Chamber of Commerce, extended the
appreciation of the Chamber for the fine cooperation received from
Victor.Kobett and Bertha 011ivier and other personnel of the
Recreation Department: during the Community Picnic held at Live Oak
Park on July 4th. She thanked the Council for their support,
particularly the use of Live Oak Park and the front page write up
in the City Newsletter.
RECESS TO CRA:
The City Council recessed. at 8:08 p.m. to meet as the Community Redevelop-
ment Agency; Mr. Dennis being absent.; approved the minutes of the regular
meeting held June 15 , 1976:;- adopted : resolution approving warrants and
demands; and received report, of progress in the sale of Parcel B -5 and
B -6, Minutes are set forth in full in the record of the Agency.
RECONVENE AS CITY COUNCIL:
19. ACTION ON REQUEST BY CRA:
There was no action to be taken.
20. MATTERS FROM CITY OFFICIALS:
A. Request to attend City Clerk's Institute, July 25 -31, Santa Cruz
City Manager Koski presented request for Chief Deputy City Clerk's
attendance to City Clerk's Institute sponsored by the League of
California Cities to be held at the University of California, Santa
Cruz, July 25 -31, 1976.
Councilman Tyrell moved to approve the request with attendant expenses,
seconded-by Councilman. Gilbertson and carried.
B. Waiver of Preliminary Soil Report re: Tract No. 32644
City Manager Koski presented request from developer of Tract No.
32644, on Garibaldi Avenue east of Golden West to waive preliminary
soil report which under state regulations and. City ordinance may be
waived under. certain conditions. Mr, Koski also presented letter
from City Engineer recommending denial on the basis he has no
knowledge of the expansive nature of the soils in subject tract.
Councilman Tyrell moved to deny request for waiver of preliminary
soil report pursuant to City Engineer's letter dated July 6, 1976,
seconded by Councilman Gilbertson and carried.
C. Request for Extension...: of Working Days: Contract 44, 4, Live Oak Park
City Manager Koski .pr-esented,requ.est for extension of working days
on Contract #4;.Electrical /Telephone Reconnect at Live Oak Park,
made necessary because of Edison Company's inability to provide the
proper transformers for the project.
Councilman Tyrell moved to authorize an extension of twelve (12)
working days for Contract #4, revised completion date being
July 23, 1976, seconded by Councilman Gilbertson and carried.
D. Councilman Gilbertson inquired whether any progress is being
made on the Temple City Junction Restaurant and Railroad Museum
being under a Conditional Use Permit. Following brief discussion,
Council directed staff to communicate the City's desire to see the
project completed pursuant to a time schedule to the owner of the
property.
E. Councilman Tyrell expressed a desire to form a citizens con -
servation.committee and requested the matter be placed on the next
study session agenda.

In answer to Councilman Tyrell's question regarding application
for funds under SB 174, Parks and Recreation Director Kobett
stated he would be attending a planning meeting in the near future
and anticipated application forms will be available following the
meeting,
Councilman Tyrell requested staff advise personnel at the West San
Gabriel Valley Juvenile Diversion Project office to send official
notices, etc. through the City Hall rather than to his home.
F. Mayor Greenberg stated he and the City Manager and Assistant
City Manager had taken part in a ride -along in a Sheriff's vehicle
equipped with new radar unit which can be operated while the vehicle
is on patrol throughout the City, which was a very impressive and
informative demonstration.
Mayor Greenberg also expressed concern with the most recent report
from the Sheriff's Department relating to accidents, particularly
those with injuries, which report also noted citations are down
on speeding violations.
21. ADJOURNMENT:
On motion by Councilman Tyrell, seconded by Councilman Gilbertson
and carried, the meeting adjourned at 8:30 p.m. Next regular
meeting of the City Council will be held Tuesday, July 20, 1976
in the Council Chamber of the City Hall.
