HomeMy Public PortalAbout075-2000 - Rezoning/PUD - So. 23rd from 750 - 950ORDINANCE NO. 75-2000 A SPECIAL ORDINANCE AMENDING THE ZONING MAP BETWEEN 750 AND 950 ON THE WEST SIDE OF SOUTH 23RD STREET, RICHMOND, INDIANA WHEREAS, the zoning map designates and describes the property located between 750 and 950 on the west side of South 23rd Street, Richmond, Indiana as R-2 One Family Residence District; and WHEREAS, it is desirable to change the zoning designation to the R-4 Multi-Family Residence District and to a Planned Unit Development (PUD) District to allow development of a PUD with four (4) apartment buildings and forty-one (41) single, double, and triple family units located on forty-one (41) lots. NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana as follows: 1) the zoning designation of the property described herein is hereby changed to the R-4 Multi-Family Residence district and to a Planned Unit Development (PUD) District to allow development of a PUD with four (4) apartment buildings and forty-one (41) single, double, and triple family units located on forty-one (41) lots. the concept plan, attached hereto as Exhibit A, is hereby incorporated by reference and made a part of this ordinance. The legal description of the subject property is Pt. SE ¼ 4-T13N-R1W, and is more particularly described in Exhibit B, attached hereto and hereby incorporated by reference and made a part of this ordinance. The following commitments, which were presented to and/or required by Common Council, shall be made a part of the Concept Plan and be made a part of the PUD. Apartment units will rent for a minimum monthly rate of $700.00. Single family homes will have a selling price of a minimum of $140,000.00 each. Condominium units will have a selling price of a minimum of $125,000.00 each. A Homeowner’s Association shall be established and maintained in accordance with the approved Charter. Deceleration lanes shall be constructed and maintained along the west side of South 23rd Street. A six feet high chain link fence will be constructed and maintained around three sides of the perimeter with the front or east side fenced with wrought iron. The chain link fence would be covered with vinyl material and planting of ivy to cover it. All common open spaces and drainage area will be maintained by the Homeowner’s Association. The location of the apartment’s drive and parking lots shall be in compliance with the Concept Plan including the 90 feet set back of the west apartment building. An alley would be included as set forth on the Concept Plan. At least nine (9) residential units must be complete before construction on the apartment building could begin.
