CITY OF MEDINA
RESOLUTION NO.
RESOLUTION EXCEPTING LOYD R. HALL DIVISION
WHEREAS, Loyd R. Hall Si/V6,/f
is the owner of real estate as described as: Lots 19, 20 and the East 54.5
ft. of Lot 21, Block 20, Independence Beach, Hennepin County, said property
being three separate parcels of record prior to the 16th day of March, 1976,
and
WHEREAS, the said owner has made application to divide the property
as follows:
Parcel 1: The West half of Lot 20, and the East 54.5 ft.
of Lot 21, Block 20, Independence Beach,
Hennepin County;
Parcel 2 : Lot 19 and the East half of Lot 20, Block 20,
Independence Beach, Hennepin County;
WHEREAS, the proposed divided parcels are served by public sanitary
sewer and water and the owner has requested a fair division of the special
assessments heretofore levied; and
WHEREAS, none of the property has previously been the subject of a
division of consolidation under this ordinance; and
WHEREAS, the proposed division will not create a need for additional
streets; and
WHEREAS, a survey of the property, a sketch of the proposed division
and a concise legal description have been filed as part of this application;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Medina, as follows:
1. That the said division is hereby excepted from the Platting
Code in accordance with Ordinance No. 159;
2. Existing special assessments for public improvements shall
be assigned as follows:
Parcel 1: 100 % thereof
3. Variances are granted from the lot width requirements and
the lot area requirements of the Medina Zoning Ordinance,
to the extent required by the plans submitted;
4. A practical difficulty exists in that the original surveys of
Independence Beach contain ambiguities and uncertainties
making it impossible to reconcile the survey lines with
the lot lines established by long usage, and the unusual
size and topography of the lots create a hardship when
the Ordinance setbacks are imposed.
5.
PROVIDED HOWEVER, that this resolution shall be conditioned upon
the following requirements:
1. The applicant shall obtain a land division from the Hennepin
County Finance Department consistant herewith.
2. The applicant shall pay an administrative fee in the amount
of $ rC .
3. No construction permits shall be issued for Parcel 1 or Parcel 2
until compliance with the foregoing conditions has been demonstrated.
4. Assessments for public improvements on Parcel 2 shall be levied
in accordance with Medina Resolution No. 75-37 and Chapter 444
of Minnesota Statutes.
