HomeMy Public PortalAboutResolution 04-43061 1 RESOLUTION NO. 04 -4306 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPROVING A NEGATIVE DECLARATION, ALONG WITH MITIGATION MEASURES FOR THE TEMPLE CITY HIGH SCHOOL TENNIS COURT RENOVATION PROJECT (TEMPLE CITY UNIFIED SCHOOL DISTRICT) THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE: SECTION 1. Based: upon information provided by the applicant and computer generated illustrations of the proposed. improvements and renovations to be made to the four tennis courts located along Lemon Avenue on the grounds of the Temple City High School and based upon information provided in the Staff Report and the Environmental Assessment, and based upon testimony received at a noticed Public Hearing before th,e City Council on November 16, 2004, the City Council hereby approves a Negative Declaration for the proposed Tennis Court Renovation Project. SECTION 2. The conclusion of the Environmental Assessment is that the proposed project will not result in significant effects on the environment and therefore, a Negative Declaration has been prepared and approved in accordance with State CEQA guidelines. The initial statement as prepared indicates that there is no potential for adverse impact(s) upon the environment generally and specifically as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. Any potential significant adverse impacts upon the surrounding area can be mitigated by mitigation measures identified in Section 3 below. SECTION 3. The Negative Declaration for the proposed Tennis Court Renovation Project which includes the installation of approximately 32 light poles and evening time activities shall include the following specific mitigation measures: 1 All lighting installed to serve the tennis courts shall be adequately shielded from abutting and neighboring residential properties such that glare is reduced to a less than significant level. Construction plans shall include specific detail as to the shielding and the lead agency shall have the right to impose additional shielding requirements, if deemed necessary. 2. The lighting shall be equipped with an automatic turn -off mechanism and all lights serving the tennis courts shall be turned off no later than 10:00 p.m. daily. 3. Activities at the tennis court shall be subject to applicable restrictions relative to ambient noise limitations within the community as set forth by the City's Noise Ordinance. SECTION 4. The City Clerk shall certify to passage and adopting of this Resolution and shall enter it into the book of original Resolutions. PASSED, APPROVED AND ADOPTED on this 16th day of November, 2004.
