CITY OF MEDINA
RESOLUTION NO. 7 7-
RESOLUTION EXCEPTING MEDINA RECREATIONS, INC.
CONSOLIDATION
WHEREAS, Medina Recreations, Inc., a Minnesota Corporation, is
the owner of real estate described as follows:
That part of Tract A, Registered Land Survey No. 161,
Files of the Registrar of Titles, County of Hennepin,
lying south of a line drawn parallel with the north line
of said Tract A, from the northeast corner of Tract C,
said Registered Land Survey, to the east line of said
Tract A;
said parcel being a separate parcel of record prior to the 16th day of
March, 1976; and
WHEREAS, the said owners have made application to divide the property
into two parcels as follows:
Parcel 1: That part of Tract A, Registered Land Survey No.
161., Files of the Registrar of Titles, County of Hennepin, lying
south of a line drawn parallel with the north line of said Tract
A, from the northeast corner of Tract C, said Registered Land
Survey, to the east line of said Tract A, and west of a line 60
feet east of, measured at right angles to and parallel with the
northerly and southerly extension of the east line of said Tract C.
Subject to a permanent easement for underground utility purposes
over, under and across that part of the West 5 feet of Tract A
Registered Land Survey No. 161, files of the Registrar of Titles
County of Hennepin, lying East of the East line of Tract C, said
Registered Land Survey No. 161 and South of a line drawn East
perpendicular to said East line of Tract C from a point thereon
distant 220 feet North of the Southeast corner of said Tract C.
(As described in Doc. No. 968030).
Parcel 2 : That part of Tract A Registered Land Survey No. 161,
Files of the Registrar of Titles, County of Hennepin, lying South
of a line drawn parallel with the north line of said Tract A, from
the northeast corner of Tract C said Registered Land Survey to
the east line of said Tract A, and east of a line 60 feet east of,
measured at right angles to and parallel with the northerly and
southerly extension of the east line of said Tract C.
WHEREAS, application has been made to combine the said Parcel 1
with adjoining land; and
WHEREAS, the said Parcel 2 is a tract of more than 5 a cres; and
WHEREAS, the proposed division will not require additional streets;
and
WHEREAS, the proposed division is served by public sanitary sewer
and water and the owners have requested a fair division of special assess-
ments heretofore levied; and
WHEREAS, none of the said property has previously been the subject
of a division or consolidation under Ordinance No. 159; and
WHEREAS, a sketch of the proposed division and concise legal des-
cription has been filed as part of the application;
NOW, THEREFORE, be it resolved by the City Council of the City of
Medina as follows:
1. That the said division is hereby excepted from the
Platting Code in accordance with Ordinance No. 159;
2. Existing special assessments for public improvements
shall be assigned as follows:

3. Provided, however, that the applicants fulfill the following con-
ditions:
a. Obtain a land division from Hennepin County Finance
Department consistent herewith.
b. Expand the parking lot existing on Parcel 2, in accord-
ance with the plans submitted and the Performance Agreement as
required by the City Council, said improvements to be guaranteed by
a Performance Bond, cash escrow, or letter of credit in the amount
of $10, 000. 00;
c. Convey to the City of Medina an easement of no less than sixty
feet for street and utilities purposes across Parcel 2, connecting
T.H. #55 with the property lying northerly of Parcel 2.
