No. 07-65 Date of Adoption Februar 15, 2007 AUTHORIZING A PROFESSIONAL SERVICES CONTRACT FOR ENGINEERING SERVICES WITH T & M ASSOCIATES - LANDFILL DISRUPTION PERMIT AND EXCESS SAMPLING AND TESTING PROGRAM WHEREAS, the Borough of Carteret is in need of professional engineering services for preliminary engineering and environmental services related to the preparation of a Landfill Disruption Permit and preparation and execution of an associated Sampling and Testing Program; and WHEREAS, T & M Associates, II Tindall Road, Middletown, NJ 07748, possesses the requisite experience and expertise to provide said services; and WHEREAS, T & M Associates has submitted a proposal to provide said services at a total cost not to exceed $18,500.00; and WHEREAS, the Mayor and the Council have reviewed said proposal; and WHEREAS, the Chief Financial Officer has certified that funds are or will be available for said purpose. NOW, THEREFORE, BE IT RESOLVED by the Mayor and the Council of the Borough ofCarteret, County of Middlesex, State of New Jersey, as follows: 1. The proposal from T & M Associates for the above described engineering services, as outlined in T & M's proposal dated February 8, 2007, at a total cost not to exceed $18,500.00 is hereby approved; 2. This action is approved as an award of a professional services contract pursuant to the Borough's Fair and Open Process as provided for and in accordance with applicable law. 3. A copy of this Resolution be forwarded to the Borough's Purchasing Department and T & M Associates. Reiman Borough of Carteret 61 Cooke Avenue Carteret, NJ 07008 tb Re: Landfill Disruption Permit and Excess Fill Sampling and Testing Program Dear Mayor Reiman: I am writing to provide you with the scope of services required for preparing the Landfill Disruption Permit and the Sampling and Testing Program for removal of excess fill soil from the former Matzel property located along Beverly Street and Industrial Road. As you are aware, since the Borough acquired a portion of the Matzel property, and the Matzel property was under a Memorandum of Agreement (MOA) with the NJDEP Bureau of Site Remediation, in order to construct its stormwater equalization basin, the Borough was required to obtain a Landfill Disruption Permit and develop a Soil Sampling and Testing Program to obtain NJDEP approval to dispose of excess fill at the Borough landfill site. With regard to the Landfill Disruption Permit Application, enclosed please find a September 2, 2005 letter to Sukhdev Bhalla, Chief-Bureau of Landfill and Recycling Management, Division of Solid and Hazardous Waste of the NJDEP, which details the application and support documents required by the NJDEP. In its July 27,2006 letter (copy enclosed), the NJDEP Solid and Hazardous Waste Management Program required a detailed Sampling and Testing Program be developed, approved and executed for the removal of all excess fill. In order to cover engineering costs associated with preparation of the Landfill Disruption Permit and preparation and execution of the Sampling and Testing Program, we respectfully request the Borough authorize T&M Associates to perform the work for a fee not-to-exceed $18,500.00 to be billed on an hourly basis in accordance with our current rate schedule.
