AUTHORIZING MAYOR TO EXECUTE AN INTER-LOCAL
AGREEMENT WITH THE COUNTY OF MIDDLESEX FOR THE
PURCHASE OF CERTAIN INTER-OPERABLE COMMUNICATIONS
EQUIPMENT
WHEREAS, the County of Middlesex ("County") has received FY 2006
Federal homeland Security Grant Funds to be used, in part, to assist municipalities
to upgrade local police communications systems to permit all law enforcement
agencies to have the capability to communicate with each other during police
operations; and
WHEREAS, pursuant to said program, the County of Middlesex has
agreed to provide the Borough of Carteret ("Borough") a grant in the amount of
$4,405.00 to either the purchase radio equipment which is compatible with the
County's Hot-Line System or to reprogram existing equipment so that it becomes
compatible with said Hot-Line System; and
WHEREAS, the Borough finds said grant to be desirable and is willing to
accept said donation pursuant to the terms and conditions set forth in the attached
Inter-Local Grant Agreement.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of
the Borough of Carteret as follows:
I. That the Mayor is hereby authorized and directed to
execute the attached Inter-Local Grant Agreement with
County of Middlesex on behalf of the Borough.
2. That a copy of the executed Grant Agreement be forwarded
to the County of Middlesex as requested.

his Agreement, made this day of , 2007, between the COUNTY OF
IDDLESEX, a municipal corporation of the State of new Jersey, having its principal
ffices at the County Administration, New Brunswick, New Jersey (hereinafter
'COUNTY") and the BOROUGH OF CARTERET having its principal offices at 61 Cooke
ve., Carteret, New Jersey (hereinafter "Municipality")
WITNESSETH
WHEREAS, the County has received FY 2006 Federal Homeland Security
rant Funds to be used, inter alia, to upgrade local police communications systems to
ermit all law enforcement agencies to have the capability to communicate with each
ther during police operations; and
WHEREAS, the County currently has an existing County Hot-Line radio
ystem that, with modifications, will allow for temporary, inter-operable communications;
WHEREAS, the County wishes to distribute certain FY 2006 Homeland
Grant Funds to the various law enforcement agencies for the purpose of
upgrading their existing radio systems to make the County Hot-Line system inter-
perable among said agencies; and
WHEREAS, the Department of Homeland Security and New Jersey
ttorney General have approved the use of said funds in this manner;
NOW, THEREFORE, in consideration of the mutual promises and
covenants contained herein, the County and the Municipality do mutually agree as
ollows:
1. The COUNTY shall provide a grant in the amount of $4,405.00 to
be used solely for the purpose of either purchasing radio equipment which is compatible
ith the COUNTY's Hot-Line System or to reprogram existing equipment so that it
becomes compatible with said Hot-Line System.
2. Once the purchase or reprogramming is completed, whichever is
the MUNICIPALITY shall submit an itemized statement to. the County
mergency Management Coordinator, together with a County voucher. Upon review
nd approval of said statement and voucher, the County Emergency Management
oordinator shall submit same for payment in accordance with normal County
rocedures. If it is determined by the Emergency Management Coordinator that any of
he expenses are not appropriate for reimbursement, then the request for
eimbursement shall be reduced by said amount.
3. The Municipality agrees and acknowledges that any future
purchases of radios and/or related equipment by it shall, at its sole cost and expense,
have the County Hot-Line programmed into said equipment.
4. The Municipality shall, at its sole cost and expense, be responsible
or all costs associated with upkeep, repair, usage and maintenance of said equipment,
including but not limited to insurance and storage.
5. The Municipality must make all necessary repairs and perform all
necessary maintenance in order to ensure that the equipment remains operative and in
good working order.
6. The Municipality shall save, protect, indemnify and hold harmless
the County and/or its elected officials, officers and employees from any and all damages
or claims for damages to persons or property which may result from the use,
maintenance or upkeep of any equipment which is purchased or upgraded pursuant to
this Agreement.
7. The parties agree and acknowledge that the County's sole
obligation hereunder is the provision of the grant funds indicated above.
8. This Agreement represents the entire understanding of the parties.

overning bodies.
IN WITNESS WHEREOF, the parties have caused this Agreement to be

Dear Mayor Reiman:
Recently you should have received an inter-local agreeme~t between Middlesex County
and your municipality addressing a law enforcement radio interoperability project. This
project was undertaken as our primary focus for expending funds from the 2006
Homeland Security Grant. Once completed, all law enforcement agencies within the
County will have the capability (during emergency situations) to use either their portable
police radios or the mobile police radios mounted in their cruisers to enable
communications with other law enforcement agencies in the County via the County Hot-
line communications network. The end result will be enhanced officer safety and law
enforcement operations efficiency.
We are asking that your governing body adopt this inter-local agreement as soon as
possible and return a true copy to County OEM Coordinator Rory Zach. Once it is
received at the County, it will be presented to the Board of Chosen Freeholders for full
execution. At that time, you will be asked to initially finance the pre-determined project
(costs were jointly calculated with members of your local police department). Upon
completion, you will be reimbursed for the cost after you submit to Mr. Zach copies of
purchase orders related to this project.
