RESOLUTION NO. 05 -4314
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE
CITY APPROVING TENTATIVE TRACT MAP 61506 AND CONDITIONAL
USE PERMIT 04 -1594, A REQUEST BY SUNG SUN CHEN AND EGL
ASSOCIATES TO SUBDIVIDE A 19,028 SQUARE FOOT PARCEL FOR
THE CONSTRUCTION OF FIVE (5) DETACHED CONDOMINIUM
DWELLING TO BE SERVED BY A SINGLE DRIVEWAY OFF OF
WELLAND AVENUE. THE SUBJECT PROPERTY IS LOCATED IN THE
MEDIUM DENSITY (R -2) RESIDENTIAL ZONE AT 5517 WELLAND
AVENUE (CHEN /JONG)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon information contained in the staff reports to the City Council and
information contained in the Planning Commission staff report as well as the Planning Commission minutes;
and based upon testimony received at a noticed public hearing before the City Council on January 18, 2005,
the City Council approves the requested Tentative Tract Map and Conditional Use Permit, based upon the
findings and subject to the conditions contained in Planning Commission Resolution No. 04- 2112PC, plus
one additional condition that a decorative trellis be constructed and that vines be planted at the base of the
trellis at the terminus of the driveway serving the subject project.
SECTION 2. In addition to the conditions of approval as enumerated above, it shall be incumbent
upon the property owner and the developer to specifically advise the property owner residing at 5522
McCulloch Avenue of the actual date when demolition is contemplated on the subject site; further, the
property owner and developer hereby agree that the gap in time between demolition and construction of an
appropriate wall or fence separating the subject site from the property addressed as 5522 McCulloch Avenue
shall be kept to the minimum period possible and during such time that there is no permanent barrier, a
temporary chain link fence or similar barrier shall be installed so as to ensure the security of the rear yard of
5522 McCulloch Avenue.
SECTION 3. This project should not result in significant effects upon the environment and a
Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial
statement as prepared indicates there is no potential for adverse impact to the environment generally and
specifically as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological
communities, including the habitat upon which the wildlife depends for its continued viability.
SECTION 4. Accordingly, Tentative Tract Map No. 61506 and Conditional Use Permit 04 -1594 are
hereby approved.
SECTION 5. The City Clerk shall certify to passage and adoption of this resolution and enter it into
the book of original resolutions.
