AN ORDINANCE AMENDING THE GREENCASTLE PLANNING
• AND ZONING ORDINANCE BY AMENDING THE ZONING MAP
WHEREAS, the Plan Commission of the City of Greencastle, pursuant to the Application of
Vemie P. & Betty Zeiner, has prepared this Ordinance to amend the Greencastle Planning and Zoning
Ordinance by amending the zoning map; and
WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing
concerning this ordinance on March 22, 2004, after timely notice of the hearing was given by publication
in the Banner - Graphic Greencastle, Indiana on March 12, 2004; and
WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the
following factors enumerated in I.C. 36 -7-4 -603 in consideration of the ordinance and determination of a
recommendation to be made to the Common Council:
I . the Comprehensive Plan;
2. current conditions and the character of current strictures and uses in each district;
3. the most desirable use for which the land in each district is adapted;
4. the conservation of property values throughout thejurisdiction; and
5. responsible growth and development; and
WHEREAS, the Greencastle Plan Commission has certified this Ordinance to the Common
Council with a recommendation by a majority vote in favor of adoption; and
. WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan
Commission and has paid reasonable regard to the factor enumerated in I.C. 36 -7 -4 -603 before acting on
this Ordinance; and
WHEREAS, the Common Council has determined that this Ordinance should be adopted without
amendment as certified by the Greencastle Plan Commission.
NOW THEREFORE be it ordained and adopted by the Common Council of the City of
Greencastle, Indiana, that:
The City of Greencastle Zoning Map of the City of Greencastle Code, is hereby amended by
changing the zoning classification for the following described real estate from AG to A/R in accordance
with I.C. 36 -7 -4 -614:
A part of the Southwest quarter of Section 25, Township 14 North, Range 4 (Vest of the Second
Principal Meridian, more particularly described to wit:
Beginning at the Northwest corner of the Southwest quarter of Section 25, Township 14 North,
Range 4 (Vest; thence South 89 degrees 00 mantes 30 seconds East 9/.00 feet with the North line
of said Southwest quarter; thence South 00 degrees 11 minutes 08 seconds (Vest 264.46 feet to the
centerline of a county road; thence North 52 degrees 48 minutes 52 seconds JVet 113.93 feet with
said centerline to the li'est line of said Southwest quarter; thence North 00 degrees 11 minutes 08
seconds East 197.17 feet with the {Test line of said Southwest quarter to the point of beginning,
containing 0.48 of an acre.
Also, apart of the Northeast quarter of the Southwest quarter of Section 26, Township 14 North,
Range 4 {Vest of the Second Principal Meridian, more particularly described as follows:
® Beginning at the Northeast corner of the Southeast quarter of Section 26; thence South 00 degrees
11 minutes 08 seconds West along the East line of Section 26 a distance of 197.17 feet to a point
in the centerline of the Greencastle and Deer Creek Road; thence with said centerline North 52
degrees 48 minutes and 52 seconds Wert a distance of 333.86 jeer to a point on the North line of
the .South ha(f of Section 26; thence South 89 degrees 00 minutes 30 seconds East along said
North line a distance of266 66feet to the point of beginning, containing. 60 of an acre.
Also, the undivided five - sixths (516) interest in the following viz: A part of the West half ofsection
25 and part of the North East quarter of the South East quarter of Section 26, all in Township 14
North, Range 4 West of the Second Principal Meridian, more particularly described, to -wit:
The South half of the South half of the North West quarter of Section 25, Township 14 North,
Range 4 West, containing 40 acres, more or less.
Also, beginning at the center of the aforesaid .Section 15, thence South 1098.24 feet with the East
line of the West half of said Section 25 to the centerline of the Greencastle and Deer Creek Road,
thence with the centerline of said road North 71 degrees West 356.40 feet; thence North 80
degrees West 924 feet, thence North 77 degrees West 91.74 feet; thence North 68 degrees West
1188 feet; thence North 53 degrees West 592.68 feet to a point on the North line of the South half
of Section 26, Township and Range aforesaid; thence East 266.64 feet to the West line of Section
25; thence East with the North line of the South {Vest quarter of said Section 25, 2644.62 feet to
the point of beginning, containing 45.10 acres, more or less.
There being a total of 86.18 acres in the four above described parcels.
® With the condition that the property owner and all subsequent property owners abide by all laws,
rules, and regulations concerning noise, and other conditions or commitments stated in the minutes of the
Plan Commission, March 22, 2004.
This ordinance shall have full force and effect upon passage. The Clerk- Treasurer of the City of
Greencastle is ordered to have this Ordinance published by inserting a copy of the Ordinance in each of
the two (2) sets of the City of Greencastle Code maintained on file for public inspection in the office of
the Clerk- Treasurer.

The reason for the re- zoning request is to allow the real estate to be used for single family

Division of property in Greencastle Twp.
Today I met with Gib Wagle, Nancy Fogel, and yourself to discuss the division of
property located in Section 17, Greencastle Township, being a proposed 1.75 + /- acres
with no dwelling for lot one and 1 +/- acres with a dwelling for lot two, 3.87 + /- acres with
barn and septic and 8.30 +/- acres with a dwelling.
Due to current features and structure support a development standard variance due to site
specific and I would support rezoning it to AR (Agricultural Rural) from Doc Jones to
Rockville Road which would adjoin property currently zoned SDI this would create a
transition from single- family dwelling to agricultural uses.

5.4 Temporary Use /Structure Standards
•
Part 1: These general Temporary Use /Structure Standards apply to
the following district(s):

A. Temporary Structure Standards: All temporary structures shall conform
to the following requirements:
1. Applicable Development Standards- Temporary structures must meet
all development standards for a permanent structure unless otherwise
specified in this Chapter.
2. Trailers as Temporary Structures Any trailer used as a temporary
structure must be equipped with skirting on all four sides which match
the exterior material of the trailer.
3. Temporary Structure Time Limits- Any temporary structure used to
house a permitted use (such as temporary school classrooms) shall be
permitted for up to 1 year.
B. Temporary Use and Structure Standards: Temporary uses and structures
are permitted in any zoning district provided that the use is a permitted use
in that zoning district. All temporary uses and structures shall conform to
the following requirements:
I. Permit Requirements All temporary structures or uses shall require a
® permit unless otherwise specified in this Article. No temporary use or
structure, or the signage, lighting, landscaping, or parking areas for
such facilities shall be constructed, placed upon a site, or altered prior
to all necessary permits being obtained.
2. Time Limits: Temporary uses and/or structures which seek extensions
of the initial time limits established for that use or structure in this
Chapter shall be subject to the approval of the Board of Zoning Appeals.
a. An unlimited number of 1 year extensions of time may be granted
for a temporary use or structure by the Board of Zoning Appeals.
b. The Board may impose reasonable conditions as part of its approval.
c. No extensions of the time limits described in this Chapter shall be
considered for any temporary use or structure that violates any
conditions listed in this Chapter or any other provision of this
Ordinance.
3. Removal Conditions: All temporary uses or structures must be removed
and the site reverted to its original condition within the duration of the
permit.
