CITY OF MEDINA
RESOLUTION NO. 7 7- 3.6"
RESOLUTION EXCEPTING THE T.R.A. INC., CONSOLIDATION
FROM THE PLATTING CODE UNDER ORDINANCE NO. 159
WHEREAS, T. R. A Inc., a Minnesota Corporation, is the owner of three tracts
of real estate which are described on Exhibit A which is attached hereto and made a part
hereof by reference, said property being a single parcel of record prior to the 16th day
of March, 1976; and
WHEREAS, the said owner has made application to combine the three parcels of
property into the following two parcels of property:
Parcel A: See Parcel A which is attached hereto and made a part hereof
by reference;
Parcel B: See Parcel B which is attached hereto and made a part hereof
by reference;
WHEREAS, the proposed divided parcels are served by public sanitary sewer and
water and the owner has requested a fair division of the special assessments heretofore
levied, to -wit: dividing the remaining special assessments between Parcel A and Parcel
B pro rata, based upon the number of square feet in each parcel; and
WHEREAS, none of the property has previously been the subject of a division or
consolidation under this ordinance; and
WHEREAS, the proposed division will not create a need for additional streets; and
WHEREAS, a survey of the property, a sketch of the proposed division and a concise
legal description have been filed as part of this application;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina
as follows:
1. That the said division is excepted from the Platting Code under Ordinance No.
159;
2. Existing special assessments for public improvements shall be divided between
Parcel A and Parcel B on a square footage basis and the City Engineer is here-
by directed to calculate the square footage and assign the assessments and place
said information on file with the City Clerk;
3. That the City may require the dedication of street and utility right-of-way
if such right-of-way is required by the development plans;
4.
PROVIDED, HOWEVER, that this resolution shall be conditioned upon the follow-
ing requirements:

1. The applicant shall obtain a land division from the Hennepin County Finance
Department consistant herewith;
2. The applicant shall pay administrative fees in the amount of $150. 00;
3. This resolution shall not bind the City Council to any future development;
4. A Certificate of Owners and Encumbrancers, or other satisfactory evidence
of title shall be filed with the City Attorney;
5. No construction permits shall be issued for Parcel A or Parcel B until com-
pliance with the foregoing conditions has been demonstrated.

That part of Lot 20 lying west of the east 1150 feet thereof and north of new State
Highway No. 55 and that part of Lot 21 lying south of a line running east at right
angles from a point in the west line of said Lot 21 distant 510. 30 feet south from the
northwest corner thereof. All in Auditor's Subdivision Number 241, Hennepin County,
Minnesota.

That part of Lots 20 and 21 described as commencing at a point in the east line of
Lot 21, distant 800 feet northerly of the northerly right-of-way line of new State
Highway No. 55, as measured along the east line of Lots 20 and 21; thence west at
right angles a distance of 800 feet to the point of beginning; thence south at right angles
105.28 feet; thence west at right angles a distance of 150 feet; thence south at right
angles to the northerly right-of-way line of said Highway; thence northwesterly along
said right-of-way line to its intersection with the west line of the east 1150 feet of
said Lot 20; thence north parallel with the east line of said Lots 20 and 21 to a point
drawn due west from the point of beginning; thence east to the point of beginning.
