INC., CONSOLIDATION FROM THE PLATTING CODE UNDER ORDINANCE NO. 159 WHEREAS, T. R. A Inc., a Minnesota Corporation, is the owner of three tracts of real estate which are described on Exhibit A which is attached hereto and made a part hereof by reference, said property being a single parcel of record prior to the 16th day of March, 1976; and WHEREAS, the said owner has made application to combine the three parcels of property into the following two parcels of property: Parcel A: See Parcel A which is attached hereto and made a part hereof by reference; Parcel B: See Parcel B which is attached hereto and made a part hereof by reference; WHEREAS, the proposed divided parcels are served by public sanitary sewer and water and the owner has requested a fair division of the special assessments heretofore levied, to -wit: dividing the remaining special assessments between Parcel A and Parcel B pro rata, based upon the number of square feet in each parcel; and WHEREAS, none of the property has previously been the subject of a division or consolidation under this ordinance; and WHEREAS, the proposed division will not create a need for additional streets; and WHEREAS, a survey of the property, a sketch of the proposed division and a concise legal description have been filed as part of this application; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina as follows: 1. That the said division is excepted from the Platting Code under Ordinance No. 159; 2. Existing special assessments for public improvements shall be divided between Parcel A and Parcel B on a square footage basis and the City Engineer is here- by directed to calculate the square footage and assign the assessments and place said information on file with the City Clerk; 3. That the City may require the dedication of street and utility right-of-way if such right-of-way is required by the development plans; 4. PROVIDED, HOWEVER, that this resolution shall be conditioned upon the follow- ing requirements: Dated: 1. The applicant shall obtain a land division from the Hennepin County Finance Department consistant herewith; 2. The applicant shall pay administrative fees in the amount of $150. 00; 3. This resolution shall not bind the City Council to any future development; 4. A Certificate of Owners and Encumbrancers, or other satisfactory evidence of title shall be filed with the City Attorney; 5. PARCEL 2 810 That part of Lots 20 and 21 described as commencing at a point in the east line of Lot 21, distant 800 feet northerly of the northerly right-of-way line of new State Highway No. 55, as measured along the east line of Lots 20 and 21; thence west at right angles a distance of 800 feet to the point of beginning; thence south at right angles 105.28 feet; thence west at right angles a distance of 150 feet; thence south at right angles to the northerly right-of-way line of said Highway; thence northwesterly along said right-of-way line to its intersection with the west line of the east 1150 feet of said Lot 20; thence north parallel with the east line of said Lots 20 and 21 to a point drawn due west from the point of beginning; thence east to the point of beginning.
