HomeMy Public PortalAboutMOU- City - Urban RenewalMEMORANDUM OF UNDERSTANDING BETWEEN CITY AND URBAN RENEWAL AGENCY This Memorandum of Understanding is agreed by and between the City of McCall (City) and the McCall Urban Renewal Agency (Agency) for and in consideration of the mutual understandings contained in it and under authority of Idaho Code, to record their understandings about certain current events. 1. City grants Agency a right to enter upon those lands granted by McCall Gas Station, Inc. (MGSI) to City that are located within the Construction Limits of the Railroad Avenue Project currently being bid by Agency, and as shown on the Construction Plans, including also the right of way of the present Railroad Avenue, for the purposes of the construction projects shown on such plans. 2. Agency agrees to convey to City upon completion of construction those lands granted to Agency by the Feers, for road, bicycle path, and park purposes. 3 . Agency agrees to convey to City upon completion of construction those lands granted to Agency by the Chapmans, to the extent such lands lie within forty feet of the centerline of the road as built, but not less than the land necessary to enclose the bicycle path as built and the land between the path and the road, and a right to enter upon the few feet adjacent to such path as may be reasonable for maintenance and repair of the same. 4. City agrees to convey to Agency the land known as the Condemnation Parcel within the Memorandum of Understanding between the City and MGSI, in the vicinity of McCall Avenue and Fir Street, without consideration, for further disposition in accord with such Memorandum of Understanding (including the right to negotiate with MGSI as necessary to update the same, provided that Agency does not increase the obligations of City without City consent).
