HomeMy Public PortalAboutResolution 32-94 Un-funded MandatesRESOLUTION NO. 32-94 A RESOLUTION OF THE CITY OF MCCALL, IDAHO ENDORSING THE EFFORTS OF THE NATIONAL LEAGUE OF CITIES AND NATIONAL ASSOCIATION OF COUNTIES TO FULLY INFORM CITIZENS ABOUT THE IMPACT OF FEDERAL MANDATES. WHEREAS: Unfunded federal mandates on state and local governments have increased significantly in recent years; Federal mandates require cities and counties to perform duties without consideration of local circumstances, costs, or capacity, and subject municipalities to civil and criminal penalties for noncompliance; Federal mandates require compliance regardless of other pressing local needs and priorities affecting the health, welfare, and safety of municipal citizens; Excessive federal burdens on local governments force some combination of higher local taxes and fees and/or reduced local services on citizens and local taxpayers; Federal mandates are often inflexible, one -size -fits -all requirements that impose unrealistic time frames and specify procedures or facilities where less costly alternatives might be just as effective; Existing mandates impose harsh pressures on local budgets and the federal government has imposed a freeze upon funding to help compensate for any new mandates; The cumulative impact of these legislative and regulatory actions directly affect the citizens of out cities and counties; and There is a continuing national public education campaign to help citizens understand and then reduce the burden and inflexibility of unfunded mandates, including a National Unfunded Mandates Week, October 24-30, 1994; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL. OF MCCALL, IDAHO as follows: Section 1. That the City of McCall endorses the efforts of the Nation League of Cities and the National Association of Counties and supports working with the NLC and NACo to fully inform our citizens about the impact of federal mandates on our government and the pocketbooks of our citizens; Section 2. That the City of McCall endorses organizing and participating in events during the week of October 24-30, 1994; and finally Section 3. That the Mayor and City Council of McCall, Idaho resolve to continue its effort to work with the members of the Idaho Congressional delegation to educate them about the impact of federal mandates and actions necessary to reduce their burden on our citizens. The resolution is self explanatory and is probably already on everyone's political agenda, however we would like for you to educate and encourage your citizens to contact their Congressmen and Senators regarding the need to enact legislation which affirmatively reduces the unfunded federal mandates or otherwise positively affects Federal behavior in this regard. As you may notice, a week later this month .is officially identified as National Unfunded Mandates Week (October 24 -30). Why not have your elected body endorse a similar resolution and do a press release with the local paper proclaiming your own National Unfunded Mandates Week. The key thing is to communicate to -your federallegislators what effect unfunded mandates has on your unit of government and ask for their support in reducing unfunded Federal mandates. I appreciate knowing your views. You mentioned Congressional control over the states, counties, and school districts in your letter. The states have a justifiable frustration with federal regulatory burdens and unfunded mandates that the federal government often imposes on them. Your concerns about excessive and heavy-handed federal government rules and regulations and their impact on states' freedom are justified. Elimination of these burdensome Federal mandates is one of my primary goals, and I have co -sponsored key legislation (H.R. 4771) to stop these unfunded federal mandates and other unfair controls.
