CITY OF MEDINA
RESOLUTION 77-45
RESOLUTION ACQUIRING LAND FOR PUBLIC PURPOSES
WHEREAS, Lots 17 and 18, Block 2, Independence Beach, Hennepin County, has become
tax forfeit and the City of Medina's request for a private land sale by the County
of Hennepin to the City was approved by the County Board at a cost of $1500.00
for Lot 17 and $1500.00 for Lot 18, plus$90.00 administrative costs for a total
of $3090.00 ; and
WHEREAS, Anthony F. Kost did on March 11/7kfer to purchase said real
estate for $3000.00 plus administrative costs of $ 90.00 ; did agree to
assume financial responsibility for any special assessments heretofore levied;
and to pay the City's legal costs; and
WHEREAS, it is in the public interest to promote the consolidation of such lots
into one building site which more closely approximates the minimum lot size set
out in the Medina Zoning Code;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Medina, as
follows:
(1) There is a public purpose in acquiring Lots 17 and 18, Block 2,
Independence Beach, Hennepin County;

The City of Medina shall acquire said real estate at a cost of
$ 3090.00 and the Mayor and City Clerk are hereby authorized
to execute all documents necessary to acquire said real estate,
subject to the following conditions:
(a) Anthony F. Kost
City Clerk in the amount of $
in a form drafted by the City
Special Assessments heretofor
costs;
shall post a cash escrow with the
3090.00 ; execute an agreement
Attorney assuming liability for the
levied and to pay the City's legal
(b) The Clerk shill be directed to publish a notice of sale of
said lands to Anthony F. Kost and the terms thereof, and to
request that any person wishing to bid a higher price while meet-
ing all of said terms and conditions, notify the City Clerk in
writing within 10 days of the publication of said notice and
submit therewith a cash escrow in the amount of $ 3090.00
together with a signed agreement as set forth in Sub -paragraph
(a) hereof;
(c) If any such person shall so notify the Clerk and submit
the said escrow and the said agreements, the said real estate
shall be sold to the highest bidder at auction, said bidders
being limited to those who have posted said cash escrow and
said signed agreements.

The motion for the adoption of the foregoing resolution was duly seconded by
member Thomas Crosby and upon vote being taken thereof, the following
voted in favor of:
Laurent, Crosby, Reiser, Theis
and the following voted against the same:: none
whereupon said resolution was declared duly passed and adopted.
