RESOLUTION APPROVING THE ADMINISTRATION OF THE SALE OF THE SERGEANT
CUNNINGHAM PROPERTY BY THE REDEVELOPMENT COMMISSION
WHEREAS, the City of Greencastle (City) owns a tract of property commonly known as the Sergeant
Cunningham Site;
WHEREAS,the City placed recorded covenants upon the property which state in part:
9. Any tract conveyed by the City of Greencastle may not be redivided or otherwise conveyed to
multiple owners except with the written consent of the GEPI Development Committee,"
which consists of the Citizens Advisory Commission for Industrial Development;
WHEREAS, the City of Greencastle issued a Solicitation for Bids on Real Estate Offered for Sale on January
18,2005 for the sale of the Sergeant Cunningham property;
WHEREAS, the Common Council of the City of Greencastle approves of the Redevelopment Commission
selling the Sergeant Cunningham site, pursuant to the requirements under the Indiana Code, at a price which it
determines to be in the City's best interests;and
WHEREAS, the proceeds from the sale shall be allocated to the Redevelopment Commission and the
covenants on the property shall hereafter be administered by the Redevelopment Commission;and
WHEREAS, this Resolution shall be applicable only
yin the event of a sale of the property resulting from the
Solicitation for Bids on Real Estate Offered for Sale dated January 18, 2005. If no such sale occurs, the Citizens
Advisory Commission for Industrial Development shall continue to administer the covenants on the real estate.
NOW THERFORE BE IT RESOLVED THAT THE CITY OF GREENCASTLE Common Council hereby
approves the Greencastle Redevelopment Commission to sell the Sergeant Cunningham property under the Solicitation
for Bids dated January 18, 2005, at a price that is in the City's best interests, that all proceeds be allocated to the
Greencastle Redevelopment Commission and that the Redevelopment Commission shall thereafter administer the
covenants on the property. This delegation of authority shall only apply to a sale of the property resulting from the
Solicitation for Bids dated January 18,2005.
