RESOLUTION AMENDING RESOLUTION NUMBERS 72 -2 3 and 72 -24 WHEREAS, certain changes in numbering on the plat of Hunter Farms Addition have occurred, as indicated by underlining on the attached amended Resolutions, NOW, THEREFORE, BE IT RESOLVED by the Medina City Council that the said Resolutions are amended as indicated on the Resolutions attached hereto and made a part hereof by reference. J � Cam' 44,-: flamuer Thomas Crosby resolution and moved its adoption: introduced the following RESOLUTION NO. 77-23 WHEREAS, soil investigation of the proposed plat of Hunter Farms Addition conducted liy the Hennepin Soil and Water, Conservation District, now on file with the City of Medina, Nave revealed that certain lots found on the proposed plat are unsuitable for the installation of conventional on -site Soil. Absorption Systems now permitted and required under Medina's Sewage Disposal Code; and WHEREAS, a report issued by the Hennepin Soil and Water Conservation District for the said plat recommends that building permits be issued only in conjunction with the installation of Innovative Mound Soil Absorption Systems on certain lots; and WHEREAS, the said Innovative Mound Soil Absorption Systems are described in the model ordinance distributed by the Hennepin Soil and Water Conservation District entitled "Sewage Disposal and Soil Treatment with Individual Systems", which model ordinance is attached hereto and made a part ereof by reference; and WHEREAS, :such Innovative Mound Soil Absorption Systems cannot be constructed under the codes of the City of Medina except by variance; SOW, IimREFORE, BE IT RESOLVED by the City Council of the City of Medina that the necessary variances for construction of Innovative Mound Sewage Disposal Systems as described herein, are hereby approved for the following Lots in Hunter Farms Addition: .ots 1 through 9, inclusive, Lots 18 and 21, Block 2; Lots 2 through 12, inclusive, Block 3 BE IT FURTHER RESOLVED that all other lots in Hunter Farms Addition are approved for construction of Conventional Soil Absorption Systems; liE IT FURTHER RESOLVED that no building permits shall issue on the lots which have been granted variances for the construction of Innovative Mound Soil Absorption Systems until the following conditions have been met: 1. • A site plan has been submitted to the building inspector showing the location of the proposed dwelling and the location of the proposed Soil Absorption System; Plans and specifications for the Innovative Mound Soil Absorption System have been designed by a Registered Professional Engineer and such plans (a) have been approved by the City Engineer; (b) meet or surpass the then current standards, rules and regulations of the applicable watershed district or organization; (c) meet or surpass the standards, rules and regulations of the Pollution Control Agency including specifically, WPC 40 as finally adopted, and regulations of such agency. (d) meet or surpass the standards, rules and regulations of the Metropolitan Council, divisions thereof and any other governmental agency having jurisdiction. 3. The contractor constructing the Soil Absorption System has been approved by the City Engineer. IT FURTHER RESOLVED that the actual installation and construction of the Innovative Mound Soil Absorption System shall be supervised by a Registered Professfonal Engineer, shall be subject to inspection by the City Engineer and that all City expenses for such inspection and for reviewal of the plans shall be borne by the applicant for the building permit. OE IT FURTHER RESOLVED that each initial homeowner be furnished with a copy of the then current Medina ordinance relating to maintenance of sewage disposal systems. Dated: ATTEST: June 21 , 1977 Donna Roehl, Clerk Wayne Neddermeyer, Mayor The motion for the adoption of the foregoing resolution was duly seconded by member Arthur Theis , and upon vote being taken thereon, the following voted in favor thereof: Theis, Crosby, isieddermeyer, Laurent, Reiser and the following voted against the same: :+one whereupon said resolution was declared duly passed and adopted. .Iemur Arthur Theis introduced the following resolution and moved its adoption: RESOLUTION NO. 77-24 RESOLUTION APPROVING THE PLAT OF HUNTER FARMS ADDITION WHEREAS, The City of Medina has adopted subdivision regulations for. the orderly, economic and safe development of land within the City; and WHEREAS, the Real Estate Group, Inc., has requested approval of the final plat of Hunter Farms Addition and the same has been approved by the Planning Commission; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina that the plat of Hunter Farms Addition is approved subject to the follow - conditions: 1. The applicant shall enter into the Development Contract which is attached hereto and made a part hereof by reference. Delivery of a deed to the lands being dedicated to the City for park land. 3. Delivery to the City Attorney of an easement for roadway and utility purposes in the East 343.00 feet of the North 20.00 feet of the South 1/2 of the Northwest 1/4 of Sectiou 13, Township 118, flange 23, tfennepin County, Minnesota. 4. A variance is granted to permit a cul-de-sac street (Carriage Drive) to a length of 1500 feet. 5. ,suilding permits on the following lots will be issued only after compliance with the Resolution Approving Sewage Disposal Systems for Hunter Farms Addition, which is attached hereto and made a part hereof by reference; Lots 1 through 9, inclusive, Lots 18 and 21, Block 2; Lots 2 through 12, inclusive, Block 3.
