CITY OF MEDINA
RESOLUTION NO.78-6
RESOLUTION EXCEPTING THE FARMERS STATE BANK OF HAMEL
DIVISION / CONSOLIDATION
WHEREAS, Farmers State Bank of Hamel, a Minnesota Corporation,
Dorian J. Hughes, a single person, and Northwestern Bell Telephone Company,
a public service corporation, are fee owners and earnest money contract pur-
chasers of the property as described on Exhibit A which is attached hereto and
made a part hereof by reference, said property being four single parcels of
record prior to the 16th day of March, 1976; and
WHEREAS, the said owners have made application to divide and consoli-
date the property as follows:
Parcel 1 (Farmers State Bank of Hamel): The West 65 feet'of the North
145 f eel of Lot 1, Block 5, Plat of Hamel, Hennepin County,
AND
that Part of Lot 1, Block 5, Plat of Hamel, lying South of the North 145
feet thereof, EXCEPT the East 90 feet thereof, Hennepin County, sub-
ject to easements of record and together with easements appurtenant thereto.
Parcel 2 (Dorian J. Hughes): The North 145 feet of Lot 1, Block 5, Plat
of Hamel, EXCEPT the West 65 feet thereof and also EXCEPT the East
90 feet thereof, Hennepin County, subject to easements of record and to-
gether with appurtenant easement thereto.
WHEREAS, the proposed consolidated parcels are served by public sanitary
sewer and water and the owners have requested a fair consolidation of special
assessments heretofor levied; and
WHEREAS, none of said property has previously been the subject of
a division or consolidation under this ordinance; and
WHEREAS, the proposed consolidation will not require additional streets;
and WIEREAS the proposed consolidation will consolidate 3 substandard
lots; and WHEREAS, a survey of the property, a sketch of the proposed consolida-
tion and a concise legal description have been filed as part of the application;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina as follows:
(1) That the said division and consolidation is hereby excepted from
the Platting Code of the City of Medina;
(2) All Special Assessments shall be paid in full.
PROVIDED HOWEVER, that this Resolution shall be conditioned upon
the following requirements:
(1) The applicant shall obtain a land division from the Hennepin County
Finance Department consistent herewith.
(2) The applicant shall pay administrative fees in the amount of $150.00
dollars.
(3) No construction permits shall be issued for Parcels 1 and 2 until
compliance with the foregoing conditions has been demonstrated.
(A) A variance is granted from the minimum lot size requirement
to permit the creation of a lot approximately 95' x 1451.

The motion for the adoption of the foregoing resolution was duly seconded
by member Arthur Theis and upon vote being taken thereon, the
following voted in favor of: Laurent, Theis, Reiser, Crosby, Neddermeyer
and the following voted against the same: None
whereupon said resolution was declared duly passed and adopted.
