AUTHORIZING AN AGREEMENT FOR EXTRAORDINARY,
UNSPECIFIABLE SERVICES - EMS BILLING SERVICES
WHEREAS, the Borough of Carteret ("Borough") is in need of a renewal contract for
billing for billing for municipal EMS/ambulance services to recover from primary and
secondary payment providers some of the costs associated with the provision of said
EMS/ambulance services; and
WHEREAS, the Borough has solicited via the Borough's web-site Requests for
Proposals for the provision of the above referenced billing services; and
WHEREAS, the Borough has received one proposal Dynamic Claims Management,
Inc., ("Dynamic"), 1000 Washington Street, Toms River, NJ 08753, to perfonll the
requested billing services and matters related thereto, including the processing of
claims with insurance companies, Medicare and Medicaid, and the coordination of
related activities with the area's emergency medical institutions and hospitals, for a
new three (3) year period; and
WHEREAS, the Borough has determined that the proposal from Dynamic IS
advantageous to the Borough, considering all relevant factors including price; and
WHEREAS, has extensive expertise and training in the field of EMS billing and
related services and has demonstrated a proven reputation in the field of EMS billing;
and
WHEREAS, the Local Public Contracts Law, N.J.S.A. 40A: 11-5 (l)(a) (ii), requires
that the Resolution authorizing the award of contracts for extraordinary, unspecifiable
services without solicitation of competitive bids and the contract itself must available
for public inspection; and
WHEREAS, the governing body has deemed it advisable to enter into a contract with
Dynamic to provide EMS billing services for the Borough for the determined new
contract ternl in accordance with the terms of its proposed contract.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough ofCarteret, County of Middlesex, State of New Jersey as follows:
I. That the Mayor and appropriate Borough officials are hereby
authorized to execute and enter into a contract with Dynamic Claims
Management, Inc., to provide EMS billing services for the Borough of
Carteret in a form acceptable to the Borough Attorney.

2. That this contract is awarded without competItIve bidding
because it is for extraordinary, unspecifiable services in accordance
with N.J.S.A. 40A:11-5 (l)(a)(ii) of the Local Public Contracts Law
because the provision of the billing services to be contracted require
special expertise and/or extensive training in the area of said services
and a proven reputation in said field which is critical and essential to
the proposal.
3. That a notice of this award shall be advertised as may be
required by law.

This request is to be awarded without competitive bids as an
extraordinary, unspecifiable service (N.J.S.A 40A:11-5 (1) (a)
I do hereby certify as follows:
1. Quotations have been solicited and are as follows:
This was the only quote received.
This is the lowest quotation. (If not, explain why in detail)
2. Insurance billing recovery from payment providers is
specialized and qualitative in nature requiring expertise,
extensive training and proven reputation.
3. This cannot be described by written specifications because:
It is not reasonably possible to draft specifications to meet
the Borough requirements of all the various insurance recovery
from payments providers and administration thereof.
4. I have reviewed the rules and regulations of the Division of
Local Government Services as contained in the local public
contract guidelines (revised) and certify that the proposed
contract may be considered as an extraordinary, unspecifiable
service in accordance with the requirements thereof.
