CITY OF MEDINA
RESOLUTION NO. 7(9_ /3
RESOLUTION VACATING PORTIONS OF MARY LANE,
BURGESS LAKE SHORE ESTATES,
HENNEPIN COUNTY
WHEREAS, the City Council has received a Petition signed by at least
a majority of the owners of property abutting the street which is described on
Exhibit A and attached hereto, and by the owners of at least 50% of the abutting
land area; and
WHEREAS, the said Petition requests that portions of the street described
on Exhibit A be vacated; and
WHEREAS, on March 21, 1978, the Council conducted a public hearing on
the question of the said street vacation, following two weeks published and posted
notice; and
WHEREAS, the Council finds that the portions of the street described on
Exhibit A are no longer needed for public purposes and that the vacation of said
portions would be beneficial to the public interest;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina that the land described on Exhibit A be and the same is hereby vacated as
a public street and that all public rights in said land heretofore vested, including
but not limited to boulevards, utility easements, and other public uses, are hereby
waived. ,

The motion for the adoption of the foregoing resolution was duly seconded by
member 71fr_ka v 'Cl. and upon vote being taken thereon, the following

whereupon said resolution was declared duly passed and adopted.

to the plat thereof on file and of record in the office of the
County Recorder, Hennepin County, Minnesota described as follows:
Beginning at the most easterly corner of Lot 1, Block 1 of said
Burgess Lake Shore estates; thence S 60° 45' 58" E (plat. bearing)
along the northerly line of Mary Lane, a distance of 6.08 feet;
thence S 40° 23' 42" W, a distance of 141.30 feet to the
northwesterly line of said Mary Lane; thence N 37° 57' 23" E
along said northwesterly line, a distance of 140.25 feet to
the point of beginning.
That part of Mary Lane of Burgess Lake Shore Estates according
to the plat thereof on file and of record in the office of the
County Recorder, Hennepin County, Minnesota described as follows:
Beginning at the common corner of Lots 3 and 4, Block 2 and
Mary Lane of said Burgess I..ake Shore Estates; thence
S-89° 27' 31" W (plat bearing) on the extension westerly of the
north line of said Lot 3, a distance of 39.42 feet; thence
southeasterly along a circular curve not tangent to the last
described line concave to the southwest having a radius of
50.0 feet and a central angle of 48° 05; 5911, a distance of
41.97 feet, the chord of said curve bears S 58° 02' 20" E,
distant 40.75 feet to the northwesterly line of said Lot 3;
thence northerly along said northwesterly line, a distance of
22.67 feet to the point of beginning.
That part of Mary Lane to Burgess Lake Shore Estates according
to the plat thereon on file and of record in the office of the
County Recorder, Hennepin County, Minnesota lying southeasterly,
northeasterly and northerly of the, following described line:
Beginning at the southwest corner of Lot 4, Block 2 of said
Burgess Lake Shore Estates; thence S 36° 17' 56" W (plat bearing)
along the extension southwesterly of the northwesterly line of
said Lot 4, a distance of 41.13 feet; thence southeasterly along
a circular curve not tangent to the last described line concave
to the northeast, having a radius of 430.86 feet and a central
angle of 3° 52' 44", a distance of 29.17 feet, the chord of
said curve bears S 52° 19' 03" E, distant 29.16 feet; thence
S 54° 15' 25" E tangent to said curve, a distance of�40.10 feet;
thence northeasterly and easterly along a circular curve not
tangent to the last described line concave to the south, having
a radius of 50.0 feet and a central angle of 50° 37' 53", a
distance of 44.18 feet, the chord of said curve bears

curve not tangent to the last described line concave to the

along a tangential curve concave to the northeast, having a radius

85.11 feet; thence northerly and northeasterly along a tangential
curve concave to the east, having a radius of 67.08 feet and a
central angle of 54° 30', a distance of 63.81 feet; thence
N 40° 23' 42" E tangent to said curve, a distance of 27.92 feet
to the northwe3terlly line of said Lot 5; thence southerly along
