WHEREAS, the street known as Allen Drive shown on Block "B"
of Plat "A", Mountain View Subdivision between Birch Avenue and
Aspen Avenue was never dedicated to the City of Moab in said plat;
and
WHEREAS, Allen Drive has never been constructed; and
WHEREAS, development has proceeded on Block "B" of said
Plat "A" contrary to any intent that Allen Drive be constructed as
a street; and
WHEREAS, the owners of property on Block "B" of said Plat
"A" desire that the public records show that Allen Drive is not
bona fide a street, that it has never been dedicated as such, and
that there is no claim of ownership by the City of Moab of the area
shown as Allen Drive on Block "B" of said Plat "A"; and
WHEREAS, the City Council agrees that the City has no
ownership or other interest in Allen Drive between Birch and Aspen
Streets;
NOW, THEREFORE, be it resolved by the Moab City Council
that the City of Moab recognizes that Allen Drive shown on Block
"B" of Plat "A" was never dedicated to the City, that the City
claims no right title or interest in the area shown as Allen Drive
and that the City has no abjection to orderly development occuring
on Block "B" of Plat "A" with no street being constructed on Block
"B" of Plat "A" between Birch Avenue and Aspen Avenue provided that
such development is consistent with the laws of the City of Moab.
A copy of Plat "A" of the Mountain View Subdivision shall
be annexed to this Resolution. Said Plat "A" was recorded in Plat
Book 2 Page 2 as entry No. 275725 on May 1, 1956.
