Resolution and moved its adoption:
introduced the following
RESOLUTION NO. 75- 46
WHEREAS, Robert Klein has requested private use of an undeveloped
street right-of-way in the plat of Hunter Farms;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Medina that such use is hereby granted in accordance with the terms of
the agreement which is attached hereto and made a part hereof by reference.

AGREEMENT FOR USE OF A PUBLIC STREET
THIS AGREEMENT, is made this :.-2-- day of ,'a-e-,
19 7Y , between the City of Medina, Hennepin County, Minneso a, a municipal
corporation, hereinafter called the CITY and Robert Klein, hereinafter re-
ferred to as Klein.
WHEREAS, the City is the OWNER by dedication of Red Fox Trail,
a street right-of-way in the plat of Hunter Farms, Hennepin County; and
WHEREAS, Klein is the OWNER of real estate located at the northerly
terminus of Red Fox Trail legally described on Exhibit A and attached hereto;
and
WHEREAS, the northerly feet of Red Fox Trail (hereinafter
called the subject tract) is not developed for vehicular traffic; and
WHEREAS, Klein has requested permission to use the subject tract as
a driveway and access to his property described on Exhibit A;
NOW, THEREFORE, the City grants permission to Klein for the use
of the subject tract for driveway access to the property described on Exhibit A,
subject to the following conditions:
(1) The City undertakes no obligation to open, construct, maintain,
repair or plow snow on the subject tract;
(2) The subject tract shall be used to serve only one dwelling unit;
(3) Subject to the approval of the City Engineer, Klein shall construct
a driveway on the subject tract, surfacing said driveway to a width of no less
than 12 feet with no less than 6 inches of recycled blacktop or an equivalent
material approved by the City Engineer, which will control dust in the area;
(4) Klein agrees, to pay the City's administrative costs in the amount
of ‘5700 dollars, to cover out-of-pocket expenses in processing this
agreement and inspecting the driveway.

The East 528 feet of that part of the North 25 rods of Lot 11,
Auditor's Subdivision Number 241, Hennepin County, Minnesota lying
West of the Southerly extension of the East line of Lot No. 6 of said
addition and lying East of the Southerly extension of the East line
of Lot No. 9, of said addition.
ALSO The South 20 feet of that part of the North 25 rods of Lot 11
Auditor's Subdivision Number 241, Hennepin County, Minnesota lying
East of the East line of Lot 6, said Subdivision extended South.
Note: The last above described tract of land is included in the
above caption for the purpose of showing title to an easement which
is appurtenant to the balance of the premises covered by the above
caption.
