' LOS ANGELES COUNTY, CALIFORNIA - RESOLUTION NO. vs-i43 " A RESOLUTION OF .THE CITY COUNCIL OF THE CITY OF LYNWOOD .APPROVING THE REPORT OF THE ADVISORY BOARD FOR FISCAL YEAR ' 1998-99 IN' CONNECTION WITH THE LYNWOOD PARKING AND BUSINESS IMPROVEMENT DISTRICT ; - WHEREAS, the City of Lynwood ("City") is a general law city ~~ . organized acid existing under the laws of the State of California; and ,, " WHEREAS, pursuant to the Parking and Business Improvement Area " L'aw of 1979, former Part 6 (commencing with Section 36500) of Division 18 of the ~ " . California Streets and Highways Code, the City Council of 1985 adopted Ordinance No. 1262 establishing a parking.. and business improvement area; and WHEREAS, the Parking and Business Improvement Area Law of 1979 was repealed and replaced with the Parking and Business- Improvement Area Law of 1989 - (California Streets and Highways Code Sections.36500, et seg.) (the "Law"), which provides that every improvement area established prior to January 1, 1990; in accordance with the Parking and Business Improvement Area Law of 1979 is valid and effective and is unaffected by the repeal of that law; and ~ ~ . ~~' ~ WHEREAS, the.City's parking and business improvement area includes ` . ~ ; ~ all of the territory within the exterior boundaries of the City, as the same existed on the - ~ date of adoption of Ordinance No. 1262;. and WHEREAS, the -Law requires that the City Council .appoint an advisory board for the City's parking and business improvement area and annually undertake ,. proceedings to levy a charge (assessment) against every business enterprise located therein; and , ' WHEREAS, by a previous resolution, the City Council established an ~ , Advisory Board for the City's parking and business. improvement area and directed the Advisory Board tq prepare a report for fiscal year 1998-99. WHEREAS, on June 17 and 24, as well as July 15, 1998 the Parking and' s ~ Business Improvement District Advisory Board met to discuss and make " recommendations pertaining to the Parking and Business Improvement District 1998/99 " Fiscal year as follows: Lynwood Chamber of Commerce $85.,0000.00; and the City of Lynwood $7,913.00; and ;...,._ ~ ~ WHEREAS, the City Council authorized the conduction of a Public Hearing to receive community input on said recommendations for August 18, 1998 at ~ their,regularly scheduled meeting of July 21, 1998, and WHEREAS, . the Public Hearing was advertised as required, and WHEREAS, the .Public Hearing to receive public input was held at the regularly scheduled meeting of the City Council on Tuesday, August 18, 1998, and WHEREAS; this report was presented to the City Council on August .18, T 998, and . } Page 2 WHEREAS; at a special meeting held on Thursday, July 30,'1998 the City Council approved an appropriation of funds in the, amount of twenty-one thousand two hundred and fifty dollars to cover various Chamber of Commerce expenditures from the "1997/98 fiscal year and directed that it be deducted from their 1998/99 fiscal year P.B.LD: allocation. . NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL AS FOLLOWS:- ' Section 1: In accordance with the directives of the City Council; the Advisory Board prepared, a report for fiscal year 1998-99 in connection with the City's parking and business improvement area, and that report was filed with the City Clerk and presented to the City Council for consideration at its regular meeting held on July 21, 1998. Section 2. Approve the following allocation for the P.B.LD. funds upon completion of a Public Hearing on August 18, 1998. :Lynwood Chamber of Commerce $63,750.00. Less appropriation from July 30,.1.998 $21.,250.00 City of Lynwood $ 7,9.13.00 Total $92,913.00 These allocations are to be expended solely for the purposed authorized by State law, all of which are identified in the report. The report does not propose any changes in the ^~` boundaries of the parking and business improvement area, the basis and method. of I levying the assessments, or the classification of businesses.. There is no surplus or deficit revenues to be carried over from the previous. fiscal year and no contributions are to be ' ,made from-sources other than the assessments: ` Section- 3.
