HomeMy Public PortalAboutResolution 05-43671 1 RESOLUTION NO. 05 -4367 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RESTRICTING PARKING ON ROSEMEAD BOULEVARD BETWEEN BROADWAY AND THE UNION PACIFIC RAILROAD OVERPASS WHEREAS, Division 11, Chapter 9, Sections 22506 and 22507.6 of the California Vehicle Code authorizes local authorities to prohibit or restrict the stopping, parking, or standing of vehicles on a state highway, in their respective jurisdictions; and, WHEREAS, Division 11, Chapter 10, Section 22651(n) of the California Vehicle Code authorizes local authorities to remove vehicles whenever a vehicle is parked or left standing in violation of a properly adopted and posted restriction on parking; and, WHEREAS, the City Council hereby determines unrestricted parking or standing of commercial vehicles on Rosemead Boulevard is detrimental to the health, safety, and welfare of the community; and, WHEREAS, vehicles regularly park on Rosemead Boulevard often pose an obstacle to the City's maintenance and street sweeping effort from fully accessing the curb and gutter, thereby preventing the removal of trash, sediment, and debris from the public right -of -way; and, WHEREAS, the City of Temple City desires to restrict parking or standing of commercial vehicles on Rosemead Boulevard between Broadway and the Union Pacific Railroad Overpass. NOW THEREFORE, the City Council of the City of Temple City hereby resolves and directs as follows: SECTION 1. Vehicle parking is prohibited on the west side of Rosemead Boulevard between Broadway and Eaton Wash and Pentland Street and the Union Pacific Railroad Overpass. Vehicle parking is prohibited on the east side of Rosemead Boulevard between Broadway and Sereno Drive and Pentland Street and the Union Pacific Railroad Overpass. SECTION 2. Vehicle parking is prohibited on the west side of Rosemead Boulevard between Eaton Wash and Pentland Street on Mondays between 8:00 a.m. — 12:00 p.m. SECTION 3. Vehicle parking is restricted to two (2) hours between 7:00 a.m. — 6:00 p.m., except Sundays. SECTION 4. A Commercial Vehicle is hereby defined as any vehicle in excess of eight (80') inches in width. SECTION 5. Commercial Vehicle parking is restricted to vehicles weighing less than 5 tons (10,000 lbs.) on Rosemead: Boulevard between Broadway and the Union Pacific Railroad Overpass. SECTION 6. • Violation of the parking restrictions imposed by this Resolution shall subject violators to the sanctions provided in applicable Federal, State, and Local law, and the Los Angeles County Sheriff's Department, or any other duly authorized law enforcement personnel, is hereby authorized to issue citations or take other lawful action to enforce this Resolution. SECTION 7. The City Manager is hereby authorized to erect or install a minimum of: (A) Thirty (30) signs on the west side of Rosemead Boulevard between Broadway and Eaton Wash and Pentland Street and the Union Pacific Railroad Overpass and on the east side of Rosemead Boulevard between Broadway and Sereno Drive which state: "No Stopping Any Time — Tow Away." Resolution No. 05 -4367 Page 2 (B) Sixteen (16) signs on the west side of Rosemead Boulevard between Eaton Wash and Pentland Street which state: "No Parking Commercial Vehicles Over 5 Tons — Tow Away" and "No Parking Mondays 8AM — 12PM." (C) Six (6) signs on the east side of Rosemead Boulevard between Sereno Drive and Pentland Street which state: "No Parking Commercial Vehicles Over 5 Tons — Tow Away" and "Two (2) Hour Parking 7AM — 6PM, Except Sundays." SECTION 8. Vehicles parked in violation of the above regulations are subject to removal. SECTION 9. The City Manager may suspend enforcement of the provisions of this resolution for any period of time as the City Manager may, in good judgment determine is necessary for the efficient administration of the City. SECTION 10. The City Clerk shall certify to the passage and adoption of this resolution. PASSED, APPROVED, AND ADOPTED on this 16th day of August, 2005.
