HomeMy Public PortalAbout1978-030i Member ^11 cirria.s ( rabbt introduced the following Resolu- tion and moved its adoption: as: CITY OF MEDINA RESOLUTION NO. 7,:f7- 3, RESOLUTION EXCEPTING RUSSELL ANDERSON COMBINATION/DIVISION WHEREAS, Russell Anderson is the owner of real estate described The West 30 feet of Lot 13, Lots 15, 16, 17, and 18, all in block 20, Independence Beach, Hennepin County, Minnesota according to the plat thereof on file and of record in the Office of the Register of Deeds in and for Hennepin County, said property being six (6) separate parcels of record prior to the 16th day of March, 1976; and WHEREAS, said owner has made application to consolidate the property as follows: PARCEL A: The West 10 feet of Lot 16 and Lot 17 and Lot 18, Block 20, Independence Beach, Hennepin County, Minnesota, according to the plat thereof on file and of record in the Office of. the Register of Deeds in and for Hennepin County. PARCEL B: The East 50 feet of Lot 16 and the West 50 feet of Lot 15, Block 20, Independence Beach, Hennepin County, Minnesota, according to the plat there- of on file and of record in the Office of the Register of Deeds in and for Hennepin County. PARCEL C: The East 10 feet of Lot 15 and Lot 14 and the West 30 feet of Lot 13, Block 20, Independence Beach, Hennepin County, Minnesota, according to the plat there- of on file and of record in the Office of the Register of Deeds in and for Hennepin County. WHEREAS, the proposed consolidated parcels are served by public sanitary sewer and water and the owners have requested a fair con- solidation of special assessments heretofor levied; and WHEREAS, none of said property has previously been the subject of a division or consolidation under this ordinance; and WHEREAS, the proposed consolidation will not require additional streets; and WHEREAS, a survey of the property, a sketch of the proposed consolidation and a concise legal description have been filed as part of the application; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina as follows: (1) That the said consolidations are excepted from the Platting Code; (2) A practical difficulty exists in that the original sur- veys of Independence Beach contain ambiguities and uncertainties making it impossible to reconcile the sur- vey lines with the lot lines established by long usage, and the unusual shape of the lots create a hardship when the ordinance setbacks are imposed; (3) Existing special assessments for public improvements shall be assigned as follows: (a) Each parcel shall bear an equal portion of the total assessments levied and remaining unpaid upon all property set out in the first paragraph of this Resolution. PROVIDED HOWEVER, that this Resolution shall be conditioned upon the following requirements: (1) The applicant shall obtain a land combination from the Hennepin County Finance Department consistent here- with; (2) The applicantshall pay an administrative fee in the amount of $ /6 0.00 . (3) No construction permits shall be issued for Parcels A, B, or C until compliance with the foregoing conditions has been demonstrated. (4) The applicant shall file with the City Attorney an abstract continued to date or an attorney's Title Opinion showing that the applicant is the fee owner of the real estate.
