'�`' introduced the following RESOLUTION APPROVING THE LUBY/ERICKSON DIVISION/COMBINATION WHEREAS, Donald M. Erickson and Ernestine E. Erickson, husband and wife have made application to the City of Medina to purchase the land described on Exhibit A attached hereto from John M. Luby and Mary C. Luby, husband and wife; and WHEREAS, the said parcel of land is approximately one-third acre in size; and WHEREAS, the applicant has agreed to attach the subject parcel to property described as Lot 1, Block 1, D. M. E. Addition and to limit construction on said combined parcel to one dwelling unit; and WHEREAS, the remaining parcel owned by John M. Luby and Mary C. Luby exceeds the minimum lot size requirements. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Medina hereby approves the Division/Combination upon the following conditions: 1. The land described on Exhibit A shall be combined with adjacent property legally described as Lot 1, Block 1 D. M. E. Addition, Hennepin County; 2. The combined parcels shall be treated as a single "Lot" as defined by the Medina Zoning Code; 3. The applicant shall procure the execution of a utility and drainage easement, upon form supplied by the office of the City Attorney, over the southerly ten feet of the property described on Exhibit A; 4. The applicant shall acquiesce in the vacation of a utility easement over the westerly ten feet of Lot 1, Block 1, D. M. E. Addition, except the southerly ten feet thereof; 5. The applicant shall pay the City's administrative costs in the amount of 4i,gee-7 to reimburse the City for out-of-pocket expenses in processing this application; 6. The applicant shall file with the City Attorney an abstract of title continued to date or an attorney's title opinion showing that the applicant is the fee owner of the real estate described on Exhibit A. BE IT FURTHER RESOLVED, by the City Council of the City of Medina that this application is approved in furtherance of the City's policy to grant variances from the platting code approving a division which creates a substandard parcel and the combination of said substandard parcel with an existing lot of record upon the condition that the combined parcels are limited to a single lot as defined in the Medina Zoning Code. qil Date ATTEST: (4\-°nri-e-) Clerk The motion for the adoption of the foregoing resolution was duly seconded by member `j.let e .4,A% and, upon vote being taken thereon, the following vptd in avor thereof: and the follwing voted agaiYist the same: 44 whereupon said resolution was declared duly passed and adopted. ERICKSON, Husband and Wife, Buyers The legal description of the property hereby sold is as follows: That part of the NW 1/4 of Section 25,.Township 118, Range 23, Hennepin County, Minnesota, described as follows: Beginning at the northwest corner of Lot 1, Block 1, D.M.E. Addition, according to the recorded plat thereof, >:lennepir. County, Minnesota; thence westerly along the westerly extension of the: north line of said Lot 1, a distance of 100 feet, to the intersection with a line drawn parallel with and 100 feet west of the west line of said Lot 1; thence southerly along said last described parallel line, a distance of 160 feet, to the intersection with the westerly extension of the south line of said Lot 1; then easterly along said extension of the south line of said Lot 1 to the southwest corner of said Lot 1; then northerly along the west line of said Lot 1, to the northwest corner of said Lot 1, and there terminating.
