CITY OF MEDINA
RESOLUTION NO.
RESOLUTION VACATING A UTILITY EASEMENT ON D.M.E. ADDITION,
HENNEPIN COUNTY
WHEREAS, the City Council has received a petition signed by at
least a majority of the owners of property abutting the easement which
is hereafter described, and by the owners of at least 50% of the abutting
land area:
That part of Lot 1, Block 1, D.M.E. Addition, Hennepin
County, described as the west 10.0 feet of the north
150.0 feet; and
WHEREAS, the said petition requests that the portion of the easement
described as aforesaid be vacated; and
WHEREAS, on September 19, 1978, the City Council of the City of
Medina conducted a public hearing on the question of the said easement
vacation, following two weeks published and posted notice; and
WHEREAS, the City Council finds that the portions of the easement
described herein are no longer needed for public purposes and that the
vacation of said easement would be beneficial to the public interest;
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina that the easement described herein be and the same is hereby
vacated as a utility and drainage easement and that all public rights
in said land heretofore vested, are hereby waived.
