RESOLUTION NO. _ 78_39
RESOLUTION EXCEPTING THE DABROWSKI CONSOLIDATION
WHEREAS, Eugenio Dabrowski and Ann Cheryl Dabrowski, husband
and wife, are the owners of real estate described as:
Lots 13 and 14, Block 2, "Independence
Beach, Hennepin County, Minnesota"; and
WHEREAS, Walter F. Kohnen and Florence T. Kohnen, husband and
wife, are the owners of
Lots 12 and 15, Block 2,"Independence
Beach, Hennepin County, Minnesota",
subject to an unrecorded Contract for Deed in favor of Eugenio Dabrowski and
Ann C. Dabrowski, husband and wife; and
WHEREAS, the four parcels of real estate above described were four
separate parcels of record prior to the 16th day of March, 1976; and
WHEREAS, the above described owners and contract for deed holders
have made application to consolidate the property as follows:
Parcel 1: Lots 12, 13, 14 and 15, Block 2,"Independence
Beach, Hennepin County, Minnesota";
WHEREAS, the proposed consolidated parcel is served by public sanitary
sewer and water and the owners have requested a fair consolidation of the
special assessments heretofore levied; and
WHEREAS, none of the described property has previously been the
subject of a consolidation under this ordinance; and
WHEREAS, the proposed consolidation will not createa need for
additional streets; and
WHEREAS, a survey of the property, a sketch of the proposed
consolidation, and a concise legal description have been filed as a part of
this application;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Medina as follows:
1. That the said consolidation is hereby excepted fromthe Platting
Code in accordance with Ordinance No. 159;
2. That the existing special assessments for public improvements
be consolidated as follows:
Parcel 1: 100% thereof
3. A variance is granted, pursuant to the site plan submitted,
from the rear yard requirements to permit construction of a dwelling within
28 feet of the rear lot line; the variance is based on a practical difficulty
which exists in construction upon a substandard lot, upon the unusual size
and topography of the lots and upon certain ambiguities and uncertainties in
the original platting surveys in the subdivision.
PROVIDED, HOWEVER, that this Resolution shall be conditioned upon
the following requirements:
1. The applicant shall obtain a land consolidation for taxing purposes
from the Hennepin County Finance Department consistent herewith.
2. The applicant shall pay an administrative fee to the City of Medina
in the amount of $ 150.00 •
3. Cedar Avenue shall be considered the street upon which the lot
fronts and the home shall be constructed in accordance with the site
plan submitted;
4. The signatures of Ann Cheryl Dabrowski, Walter F. Kohnen and
Florence T. Kohnen shall be obtained on the application for division
which was submitted.
5. No construction permit shall be issued for Parcel
with the foregoing conditions has been demonstrated.
6. Lot 16, Block 2 shall be assessed an additiona 1/2

The motion for the adoption of the foregoing resolution was duly seconded by
member William Reiser and upon vote being taken thereon, the following
voted in favor thereof:
Neddermeyer, Theis, Reiser, Crosby, Laurent
and the following voted against the same: none
Whereupon said resolution was declared duly passed and adopted.
