'Wetteecr, Vtllage Clerk.; and Alan S. i:old, Village Attoreey. On motion of Mr. Tallith, seconded by Mr. Davis, the minutes of the previous meeting of February 24, 1976 were Approved as se'mitted. Mr. Frazer Knight, told the Council that the plans for, the renovation of the Village Hall sere almost completed and requested permission to put them eut, for bids. After discussion on financing and selection of an in- terior designer, it was moved by Mr. Logan, seconded by Mr.. Davis and voted that the plans be approved and offered for bids to he opened at the next Council meeting an+i let, subject to advice from the Village .Attorney oe: financing. Mr. Gold informed the Council that: he had reviewed the statement submitted by the engineers on the beach restoration project and if the Council is satisfied with the chl rges es outlined that they would be proper. Mr. veer Oesen :liscnssed their position and on Totten of Mr. Davis, seconded by Mr. Beatty and voted, the Village Manager was authorized to pny the sem of $49,710.0i for the extra work performed. Any further payment against the basic agreement will depend upon additional don_umentetion. Mr. Cold said in his opinion the Village could reduce the Floor Area Ratio inthe Zontng Code providing it is m)t done to be arbitrary or confiscatory. Ordinance No. 182, providing for the establishing criteria for building moratorin was reed by title and ou mutton of Mr. Davis, seconded by Mr. Beatty and meted, passed on first. reading. Harbour Police Oepar.tment. It was suggested that any contract contain n prohibition against the members joining any National Union. On motion of Mr. Beatty seconded by Mr. Davis and voted the Dade County Police `tenceelent Assocle- tion was given recognition as bargaining agent, It we,s moved by Mr. Davis, seconded by Mr.. Tapltn and voted, thnt Consolidated Edison Bonds be purchased with apprex.im:rt:vty?50,000.. in the Employees Pension Plan Trust Account. Mr. Haley said that Dade County had suggested thnt the Council act as its own Local Planning Agency and that they would ee glad to assist us In the implementation of the Act, It was moved by Mr. ikavis, seconded by Mr. Logan and voted that the Council act as the Planning Agency for Bal Harbour. Mr. Gold said that he and Mr. Andersnn had worked out an agreement on the Water Rate Cases. He said that Mr, Anderson will continua with the Miami Beach Case before the Supreme Court, Also, Judge !Klein will hear the case in which Miami Beach is asking for an injunction to keep the Metro Water. and Sewer Board from enforcing its ordinance. Dade County will defend their ordinance and nothing would he dune on our part unless the Judge rules for MinmL Beach and then we would have to intervene. With reference to North Miami teach, Mr. Cold said he reviewed the file and said he has requested thnt Mr. Cohen, the rate expert for North Minn/ Bench, set up .a meeting to negotiate renewal of the c.in r.act. :r. Maley reported that. Surfside has not yet appointed an arbitrator and asked for another 30 day extension. He said it was suggested that our :agreement with Surfside might be continued on a temporary basis. Mr. Maley snid thnt Saks Fifth Avenue his requested permission to hook up to our water system and North Minn! 'leach now has an "In Plant" water connection fee, which in this caec would amount to $21,000 and would be assessed against the Village if not paid by the consumer. It was moved by Mr. Beatty, seconded by Mr. Davis and voted that Mr. Cold prepare the proper language for. Resolution No.C37, stating th t: any fee required of Ba1 Harbour Village :as a result of the North Mini,ti Bench ordinance, be passed on to the property benefitted. it was moved by Mr. Davis, seconded by Mr. raplin and voted that Mr. Maley explore with Mr, Dan Paul, nttnrney for Rai Harbour Shops the possibility of representing the Village without cost in the *forth Miami Beach "In Plant" charge matter. Miss Wetterer reported Chart.: the Commission to the Stnrus of Women had asked to be placed on the Agenda, but that there was no one present from the organization. Mr. Harold Perry and Mr. Finnan Coon, from the Sun Bank explained the purpose of the "Thumbs Up" program. Mr. Bailey of Holder Construction appeared to request a variance to extend a Saks Fifth Avenue sign beyond the south property line. It was suggested that Mr. Bailey go back to the architect and engineers to see if this sign could be recessed into the canopy.
