RESOLUTION NO. ! k- 7 4
RESOLUTION ACQUIRING LAND FOR PUBLIC PURPOSES
WHEREAS, Lots tplock o2 (o ,, Independence Beach, Hennepin County,
has become tax forfe_t an,57 the City of Medina's request for a private land
sale by the ounty of Hennepin to the City was approved by the County Board
at a cost ofo?doa for Lot // and Edog-te-f , plus ,X%
for administrative costs for a total. of eoe ; and
WHEREAS, 6) Ltiam Fenile/t did on 1 u6/7 /97, offer to purchase said
real estate for A040 65!. plus administrative costs of (,a °° ; did
agree to assume financial responsibility for any special assessments here-
tofore levied; and to pay the City's legal costs; and
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Medina,
as follows:
(1) There is a public i-urpose in acquiring,44-//tg.ataft-Q1 ,,e,frt/O Independence
Beach, Hennepin County; 444.2.E
(2) The City of Medina shall acquire said real estate at a cost of
4 ,,V 0 6 0 °Rand the Mayor and City Clerk are hereby authorized to execute
all documents necessary to acquire said real estate, subject to the foll-
owing conditions:
(a)i4.1(a/L'e» renko shall - post a cash escrow with the City Clerk
in the amount of e2 p ( 0,00; execute an agreement in a form drafted oy
the City Attorney assuming liability for the SI.ecial Assessments hereto-
fore levied and to pay the City's legal cost-;
(b) The Clerkshall be directed to publish a notice of sale of said
lands to (1).1((idrn Fe40/4and the terms thereof, and to request that any
person wishing to bid a higher price while meeting all of said terms and
conditions, notify the City Clerk in writing within 10 days of the pub-
lication of said notice and submit therewith a cash escrow in the amount
of a 0 ° together with a signed agreement as set forth in Sub -para-
graph (a) hereof;
(c) If any person shall so notify the Clerk and submit the said
escrow and the said agreements, the said real estate shall be sold to
the highest bidder at auction, said bidders being limited to those who
have posted said cash escrow and said signed agreements.
