CALL TO ORDER: Mayor Greenberg called the regular meeting of the City Council to order at 7:32 p.m. on Tuesday, November 2, 1976, in the Council Chamber of the City Hall. 2. The invocation was given by Pastor Warren Howell, Behtlehem Evangelical Lutheran Church, 5319 N. Halifax Road. 3. The Pledge: of Allegiance to the Flag was led by. Mayor Greenberg. 4. ROLL CALL: Present: i Councilmen- Dennis, Gilbertson ,Merritt,Tyrell,Greenberg Absent: Councilmen -None Also Present: City Manager Koski, City Attorney Martin, Assistant City Manager Biel, Planning Director Dragicevich, Parks and Recreation Director Kobett, Traffic Engineer Envall . 5. APPROVAL OF MINUTES: Councilman Tyrell moved to approve the minutes of the regular meeting held ,October 5, 1976, as written, seconded by Councilman Dennis and carried. Councilman Tyrell moved to approve the minutes of the Special Meeting held October 26, 1976, as written, seconded by Councilman Dennis and carried, Councilman Merritt abstaining. UNFINISHED BUSINESS: 6. PUBLIC HEARING: 7:30 p.m. ASSESSMENTS FOR STREET IMPROVEMENTS: INSTALLATION OF 7 STREET LIGHTS, HALLOWELL AVENUE, 4800 -4900 BLOCK (Pursuant; to Chapter 27, Streets and Highways Code) City Manager Koski presented background information stating the City Council, at their regular meeting held October 5, 1976, set public hearing November 2, 1976, to consider assessments for the installation of six 7,000 lumen lights on steel electroliers and one 7,000 lumen light on an existing wood pole; cost of the installation was $1,122 to be spread equally among the 32 property owners pursuant to Council policy; annexation of these lights from, Zone B to Zone A will be effective July 1, 1977 and the cost of energy for the seven'street lights is $398.72 to be spread among 30 property owners as two are presently paying a Zone.A rate. There toeing no further staff report, Mayor Greenberg declared the public 'hearing open. Mr. Steinwinter, 4821 Hallowell Avenue, inquired as to the reason the assessment ran higher than the original estimate. City Manager Koski explained at the time the improvement was estimated assessments were based on front footage, however City Council, at their regular meeting held July 20, 1976, adopted a policy of spreading costs evenly among the properties involved based upon equal benefit. There being no one else to come forward to speak, Councilman Merritt moved to close the public hearing, seconded by Councilman Gilbertson and carried. Council Minutes, November 2, 1976 - Page 2 Councilman Gilbertson moved to approve the assessments as set forth in memo dated October 25, 1976, and on file in the City Clerk's office, and to direct the Superintendent of Streets to so notify the property owners, seconded by Councilman Merritt and carried. 7. PUBLIC HEARING: 7:30 p.m. PROPOSED AMENDMENT TO THE TEMPLE CITY ZONING CODE RE: SALE OF USED CARS IN CONJUNCTION WITH NEW CAR SALES City Manager Koski presented background information, stating the Planning Commission, at their regular meeting of September 28, 1976, held public hearing and adopted Resolution No. 76 -714PC recommending to City Council an amendment to the Temple City Zoning Code relating to the sale of used cars in conjunction with new car sales providing the percentage of new cars in at least 51% of the total number of car units in investory on'the premises, the term car to include recreational vehicles. City Council, at their regular meeting held August 17, 1976, concurred with the Planning Commission recommendation relating to clarification of ambiguity with reference to the inter- pretation of automobile sale of new cars and incidental sale of used cars in the C -2 zone and referred the matter back to the Planning Commission to initiate appropriate action to amend the Zoning Code. At their regular meeting held October 5, 1976, City Council set public hearing to consider Planning Commission recommendation for November 2, 1976. Planning Director Dragicevich advised that a Negative Declaration of Environmental Impact was prepared pursuant to State law. There being no further staff report, Mayor Greenberg declared the public hearing open. No one came forward to speak to the issue and Councilman Gilbertson moved to close the public hearing, seconded by Councilman Merritt and carried. Councilman Merritt moved to certify that the Negative Declaration of Environmental Impact Report has been completed in conformance with the California Environmental Quality Act and the state guidelines and that the City Council has reviewed and considered the information contained in the report, seconded by Councilman Dennis and carried. City Attorney Martin introduced Ordinance No, 76 -439 AN ORDINANCE OF THE CITY OF TEMPLE CITY AMENDING SECTION 9380(A) OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO PERMITTED USES IN THE C -2 ZONE for first reading by title only. Councilman Merritt moved to waive further reading, seconded by Councilman Dennis and carried. 8. PUBLIC HEARING: 7:30 p.m. RESIDENTIAL PLANNED DEVELOPMENT (RPD) CASE NO. 76 -480, CASA ROBLES, 6362 -6404 OAK AVENUE City Manager Koski presented background information, stating the Planning Commission, at their regular meeting of September 28, 1976, held public hearing and adopted Resolution No. 76 -717PC recommending to the City Council a change of zone from R -1 to RPD (Residential Planned Development) for subject property; applicant proposes to build seven additional single- family residential structures in the next 10 -15 year period; there are presently three existing structures on the property; Planning Commission recommended the zone change for the reasons, 1) the proposed development is consistent with the General Plan of the City and surrounding residential development; 2) the size and shape of the property is adequate for Residential Planned Develop- ment; and 3) subject property has adequate access to Oak Avenue which is classified as a collector street. City Council, at their regular meeting held October 5, 1976 set public hearing November 2, 1976 to consider Planning Commission recommendation. Councilman Gilbertson moved to make the Planning Commission minutes a part of the record, seconded by Councilman Merritt and carried. Council Minutes, November 2, 1976 - Page 3 Planning Director Dragicevich gave staff report, stating the Planning Commission's public hearing included a request for zone variance to develop subject property with less than the required off - street parking spaces, proposing a total of 15 parking spaces for ten siggle family residences in that parking requirements for the Missionary Homes are not typical of normal residential development. Planning Commission approved the zone variance to allow a minimum of one enclosed garage parking space for each existing or newly constructed residential unit on the property to be provided concurrently with the construction of each new unit, and that five additional unenclosed off - street parking spaces shall be provided on the property, with conditions set forth in Plan- ning Commission Resolution No. 76- 716PC. A draft Environmental Impact Report has been prepared on the project and the final analysis and con- clusion was that the iiroject.will not have an adverse effect on the neighborhood, particularly in view of the fact the structures will be added in phases over a 10 -15 year period. City Attorney Martin inquired as to what basis the Planning Commission found the property to be unique to justify ten covered parking spaces and five uncovered parking spaces. Planning Director Dragicevich stated the residences are to be used by retired missionaries, many of whom do not drive. In answer to question from City Attorney Martin, Mr. Dragicevich stated there would not be adequate parking if the property changed ownership and was converted to condominiums. Councilman Tyrell stated that in his opinion some control should be placed on the property now to provide for adequate parking in the future in the event of change of ownership. Mayor Greenberg declared the public hearing open.' Mr. Ross Irwin, legal counsel for Casa Robles, stated the Casa Robles Missionary Homes is a campus like center, owned and operated by the General Church of the Nazarene, for missionaries who have returned from serving in the field, and that they have tried to anticipate their future needs and still maintain as much open space to preserve their park area, the grounds are well landscaped and beautifully maintained which blends with the present character of the neighborhood. Mr. Irwin stated in his opinion, this is an ideal opportunity for implementing the Residential Planned Development. In answer to Councilman Tyrell's question, Mr. Irwin stated they would be willing to execute a covenant for recordation,, to construct additional parking spaces in the event of sale, transfer or assignment of the pro- perty. Mr. Carl Gaete, Architect, introduced two concept drawings, one showing the plan for the entire campus which now consists of 21 units, 18 on the west side of Oak Avenue, three on the east, and showing the proposed seven two - bedroom units'; the other a typical floor plan.. Mr. Gaete proposed the RPD zoning based 'on the fact Casa Robles existed before the present zoning was established; 80% of the property will remain open space with 60% landscaped; the development will not distract from the aesthetic value of the neighborhood; that the retirement center represents a unique situation and will remain under one ownership.. Reverend Pierson, 6362 N. Oak, Avenue, Director of Casa Robles, stated that there has never been a parking problem with many of the residents not driving and, although they have many visitors, those are not on a lengthy basis. Councilman Gilbertson moved to close the public hearing, seconded by Councilman Merritt and carried, Councilman Merritt moved that the Draft Environmental Impact Report be amended to include the comments of those testifying at the public hearing by incorporating a copy of the minutes in the report; that the City Council certify the Environmental Impact Report has been completed in Council Minutes, November 2, 1976 - Page 4 conformance with the California Environmental Quality Act and the state guidelines and that the City Council has reviewed and con- sidered the information contained in the report; and that any adverse environmental impact contained in the report is overruled and counter- balanced by economic and social needs, objectives and concerns in pro- viding this community with private improvements of municipal import as set forth in the findings indicated in the minutes, seconded by Councilman Dennis and carried. City Attorney Martin advised that Planning Commission Resolution No. 76 -716PC may be deemed amended by adding a new condition that neither the variance or zone change shall become effective until applicant has signed a covenant to the general effect that if the property is ever sold the developer or owner will construct two covered parking spaces for each unit built or in existence on the site, and that the covenant will be en- forced by the City with reasonable attorney fees. Councilman Merritt moved to approve the amendment to Planning Commission Resolution No, 76- 716PC, seconded by Councilman Tyrell and carried. City Attorney Martin introduced Ordinance Noe 76 -440 AN ORDINANCE OF THE CITY OF TEMPLE CITY PROVIDING A CHANGE OF ZONE IN RESIDENTIAL PLANNED DEVELOPMENT CASE NO. 76 -480 for first reading by title only, Councilman Gilbertson moved to waive further reading, seconded by Councilman Merritt and carried. 9. PUBLIC HEARING: 7:30 p.m. ENVIRONMENTAL IMPACT REPORT RE: GRANTS APPLICATIONS UNDER THE PUBLIC WORKS EMPLOYMENT ACT City Manager Koski presented background information, stating pursuant to State of California grant application instructions for the Public Works Employment Act of 1976, and the City Council authorization to participate, staff has prepared and submitted environmental documents for the projects approved. A draft Environmental Impact Report was prepared for the Live Oak Park project; a Negative Declaration for the construction of new sidewalks; and determined the reconstruction of alleys is exempt in accordance with California Environmental Quality Act of 1970, as amended. Notice of Public Hearing was published for the Environmental Impact Report for Live Oak Park as required by law. There being no further staff report, Mayor Greenberg declared the Public Hearing open. There being no one to come forward to speak, Councilman Merritt moved to close the public hearing, seconded by Councilman Dennis and carried. Councilman Gilbertson expressed some concern and questioned the difference between the original estimate for Live Oak Park improvements in the amount of $31.0,000 and the architects estimate of $464,000, City.Manager Koski advised the difference represents two additional tennis courts, and engineering and design costs. Councilman Gilbertson moved that the City Council certify that the Environmental Impact Report prepared for the Live Oak. Park project has been completed in conformance with the California Environmental Quality Act and the state guidelines and that the City Council has reviewed and considered the information contained in the report, and that any adverse environmental impact contained therein is overruled and counterbalanced by economic and social needs, objectives and concerns in providing the community with public improvements of municipal import; to certify the Negative Declaration of Environmental Impact prepared for the construction of new sidewalks; and to find the reconstruction of alleys in the business district categorically exempt under state guidelines, seconded by Councilman Tyrell and carried. City Attorney Martin presented agreements for professional services in connection with the grants. applications; 1) Erikkson, Peters & Thoms, landscape architects in the amount of $3,500; 2) Store, Matakovich & Wolfberg, engineering for electrical and plumbing facilities in the amount of $1,500; and 3) Harry Shoemaker, architect, in the amount of $800. Counci man Tyrell moved to approve the agreements and authorize the Mayor and City Clerk to sign, and to appropriate additional funds in the amount of $5,800 and amend the adopted budget accordingly, seconded by Councilman Dennis and carried. Council Minutes, November 2, 1976 - Page 5 10. REQUEST FOR DEMOLITION OF SUB- STANDARD BUILDING - 9232 E.. BLACKLEY STREET City Manager Koski advised the City Council, at their regular meeting held October 5, 1976, reviewed recommendation from the Building Depart- ment to proceed with the demolition of structure located at 9232 E. Blackley Street pursuant to Chapter.99 of the Building Code, and continued the matter to November 2, 1976 to allow the owner sufficient time to settle his insurance claim. Staff was advised that the owner's insurance claim has been settled and he has retained a contractor to demolish the building and construct a two - bedroom residential building on the pro- perty, and that the contractor has taken out his permit to demolish. Councilman Tyrell moved to continue the matter to November 16, 1976, seconded by Councilman Gilbertson and carried. 11. ACCEPTANCE OF WORK: STREET IIMPROVEMENTS - ENCINITA AVENUE, LAS TUNAS DRIVE TO BROADWAY City Manager Koski presented background information, stating the contract for the improvements on Encinita Avenue were awarded to E. C. Construction Company under Cash Contract No. 8862X in the amount of $97,756.98; an additional work was added to the original contract to properly join existing driveways to the new street grade at various locations within the project limits in the amount of $564. The Road Commissioner has recommended acceptance of the work performed under the contract. Councilman Tyrell moved to accept the work completed and approve and authorize the additional work under Cash Contract No. 8862X, authorize payment in the amount of $50,702.12, authorize the filing of Notice of Completion and release of the 107 retention at the end of the 35 -day lien period, seconded by Councilman Gilbertson and carried. 12. PUBLIC NUISANCE CASES: Case No. 76 -35, 9173 -75 Las Tunas Drive and Case No. 76 -36, 5330 Fratus Drive City Manager Koski advised that City Council, at their regular meeting held September 7, 1976, adopted resolutions ordering abatement of sub- ject public nuisances within 30 days; the 30 -day period has lapsed and an on -site inspection was conducted and determined the property owners have not complied. The City Attorney has advised that if the City chooses not to abate the nuisance by City forces or contract, several alternatives are available, being either a criminal action filed by the District Attorney under Penal Code Section 370, or Civil action filed by the City Attorney. Councilman Tyrell moved to process both cases with the District Attorney's office under Section 370 of the Penal Code., seconded by Councilman Gilbertson and carried. 13, AMENDMENT TO AGREEMENT: TRACT MAP AND PARCEL MAP CHECKING City Manager Koski presented background information, stating the City Council, at their regular meeting of August 3, 1976, approved agreement appointing the County Engineer as City Engineer for checking tract and parcel maps which updated the then current agreement to meet current state law requirements. The agreement had been forwarded to the City prior to its review by County Counsel; County Counsel revised the agree- ment and re- submitted for Council review prior to being submitted to the Board of Supervisors. The City Attorney has reviewed and approved the revised agreement. Councilman Gilbertson moved to approve the revised agreement and authorize the Mayor and City Clerk to sign, seconded by Councilman Tyrell and carried. 14 RESOLUTION NO. 76 -1593: INSTITUTING PROCEEDINGS FOR CONSTRUCTION OF SANITARY SEWERS - LOMA AVENUE City Manager Koski presented background information, stating City Council, at their regular meeting held June 1, 1976, authorized staff to proceed Council Minutes, November 2, 1976 - Page 6 with the Loma Avenue Sewer Petition District; County Engineer submitted an estimated cost of the project and the proposed assessment was listed for each parcel, and City. Council, on August 17, 1976 authorized the circulation of petition within the proposed district. Petition was returned with signatures of seven property owners which represents 75.4% of the area involved; the proposed resolution will institute proceedings for the construction of sanitary sewers within the proposed district and direct preparation of plans and specifications. Councilman Tyrell moved to adopt Resolution No. 76 -1593 A RESOLUTION INSTITUTING PROCEEDINGS ACKNOWLEDGING WAIVER OF DEBT LIMIT INVESTIGATION PROCEEDINGS AND DIRECTING. PREPARATION OF PLANS AND SPECIFICATIONS, seconded by Councilman Gilbertson and carried. NEW BUSINESS: 15. RECOMMENDATION FROM TRAFFIC COMMISSION - Meeting of October 6, 1976 GARIBALDI AVENUE AT OAK AVENUE - Additional Boulevard Stop Signs City Manager Koski presented background information, stating the Traffic Couunission concurred with the Traffic Engineer's recommendation to place stop signs on Oak Avenue at the north and south approaches to Garibaldi Avenue, making the intersection a four -way stop, based upon data presented. Councilman Gilbertson moved to approve the installation of boulevard stop signs on Oak Avenue at the north and south approaches to Garibaldi Avenue, seconded by Councilman Tyrell and carried. 16. RECOMMENDATION FROM PARKS & RECREATION COMMISSION - Meeting of October 20, 1976 REQUEST FOR USE OF FACILITIES AT LIVE OAK PARK - LINCOLN TRAINING CENTER City Manager Koski presented background information, stating the Parks and Recreation Commission approved a request from the Lincoln Training Center to conduct a Social Dance and Party in the auditorium at Live Oak Park on Friday, November 12, 1976, from 7:30 p.m. to 9:30 p.m. for the members of the Training Center subject to the conditions of park use and recommended to City Council their application be approved on a fee -free basis. Councilman Merritt moved to approve request for use of the auditorium at Live Oak Park Friday, November 12, 1976 from 7:30 p.m. to 9:30 p.m. by Lincoln Training Center with additional conditions 1 through 3 set forth in staff memo dated October 22, 1976, and on file in the City Clerk's office, seconded by Councilman Gilbertson and carried. 17. RECOMMENDATIONS FROM PARKING COMMISSION - Meeting of October 21, 1976 A. HANDICAPPED FACILITIES - LAS TUNAS DRIVE City Manager Koski presented recommendation from the Parking Commission that City Council consider as a matter of policy establishing a priority for the construction of handicapped facilities at all intersections in the downtown business district. Mayor Greenberg stated he would like to see facilities and parking spaces for the handicapped in the City parking malls included. Councilman Gilbertson moved to refer the recommendation to budget session, to include facilities and parking spaces for the handicapped in the City parking malls, seconded by Councilman Tyrell and carried. B. RENEWAL OF AGREEMENT - PERMIT TO CROSS OVER PEDESTRIAN MALL NO. 4, PARKING DISTRICT #4 - GWENDOLYN HARRIS, 96592 LAS TUNAS DRIVE City Manager Koski advised the Parking Commission, at their regular meeting of October 21, 1976, reviewed conditions established by City Council III18 RECOMMENDATION FROM PLANNING COMMISSION - Meeting of October 26, 1976 AMENDMENT TO TEMPLE CITY ZONING CODE SECTION 9326 RE: MAXIMUM HEIGHT OF FREE - STANDING SIGNS Council Minutes, November 2, 1976 - Page 7 relative to the agreement permitting Mrs. Harris, 96592 Las Tunas Drive, to cross over the pedestrian mall in Parking District No. 4, and it was the consensus of the Commission, based upon visual inspection, that Mrs. Harris met all conditions of the agreement, and recommended renewal of subject agreement. Councilman Gilbertson moved to approve renewal of agreement subject to conditions as set forth in original agreement dated January 23, 1976, and authorize Mayor and City Clerk to sign, seconded by Councilman Tyrell and carried. City Manager Koski presented background information, stating the Plan- ning Commission, at their regular meeting held October 26, 1976, held public hearing and adopted Resolution No. 76 -723PC recommending to the City Council an amendment to the Temple City Zoning Code relating to maximum height of free - standing signs. Councilman Gilbertson moved to set public hearing to consider Planning Commission recommendation relating to maximum height of free - standing signs November 16, 1976, seconded by Councilman Tyrell and carried. 19. SET PUBLIC HEARING: REVOCATION OF LICENSE - 5022 BALDWIN AVENUE City Manager Koski presented background information, stating the City Council received a petition signed by 21 persons complaining about motorcycle noise, barking dogs, and semi - trucks being parked for days at a time on Baldwin Avenue at subject address emanating from the operation of a funeral escort service as a home occupation. The City Attorney advised the property owner October 5, 1976 of his violation of Section 9117(H) (6) giving ten days notice to abate the nuisance, and advising the City would have no alternative but to revoke his license if the violations are not terminated. Councilman Tyrell moved to set public hearing as required under Section 5137 of the Temple City Municipal Code for December 7, 1976, seconded by Councilman Gilbertson and carried. 20. RESOLUTION NO. 76 -1590: RE: STREET LIGHTING ZONE BOUNDARIES - ZONE B TO ZONE A A. NADINE STREET - 9800 -9900 BLOCK B. ._HALLOWELL AVENUE - 4800 -4900 BLOCK C. CAMBURY AVENUE - 5400 BLOCK City Manager Koski stated that during the calendar year 1976 street lighting improvements were completed for the subject limits; legal descriptions of properties abutting the three streets were prepared by the County Engineer for annexation proceedings, and in order to annex the subject streets and abutting properties into Zone A of the Temple City Lighting District, in accordance with the Street. Lighting Act of 1911, the City Council shall adopt a resolution declaring its intention to hold public hearing relating to an adjustment of its street lighting zone boundaries. Councilman Tyrell moved to adopt Resolution No. 76 -1590 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DECLARING ITS INTENTION TO HOLD A PUBLIC HEARING RELATING TO AN ADJUSTMENT OF ITS STREET LIGHTING ZONE BOUNDARIES and setting public hearing December 7, 1976, seconded by Councilman Dennis and carried. 21 RESOLUTION NO. 76 -1591: EMPLOYMENT OF PERSONNEL Councilman Gilbertson moved to adopt Resolution No. 76 -1591 A RESOLUTION OF THE CITY OF TEMPLE CITY APPOINTING PERSONNEL, seconded by Councilman Tyrell and carried. RESOLUTION NO 76 -1592: WARRANTS & DEMANDS, DEMAND NOS. 5256 THRU 5367 IN THE AMOUNT OF $126,427.59 Councilman Tyrell moved to adopt Resolution No. 76 -1592 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $126,427.59, DEMAND NOS. 5256 THRU 5367, seconded by Councilman Dennis and carried, Mayor Greenberg noting his non- participation with respect to check number 5327. III 23. COMMUNICATIONS: A. Claim for Damages - Marks, 9225 E. La Rosa Drive City Manager Koski presented claim from attorney for Dorothy Marks for injuries alleged to have been sustained August 17, 1976 as a result of tripping over an elevated sprinkler head on city property located at Encinita Avenue and Broadway. Councilman Tyrell moved to deny and refer to City's insurance carrier, seconded by Councilman Gilbertson and carried. 24. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK: No one came forward. RECESS TO CRA: The City Council recessed at 8:46 p.m. to meet as the Community Redevelopment Agency, all members being present; approved the minutes of the regular meeting held October 5, 1976; approved time extension for approval of the Disposition and Development Agreement by Vornado,,Inc.; approved proposed wall signs for Albertson's, Inc.; approved proposed free - standing sign for the Liquor Mart in Parcel C; and adopted Resolution approving warrants and demands. The minutes are set forth in full in the record of the Agency. RECONVENE AS CITY COUNCIL: 25. ACTION ON REQUEST BY CRA: There was no action to be taken. 26. MATTERS FROM CITY OFFICIALS: A. Bus Bench Ordinance City Manager Koski advised that since the development and improvement of Rosemead Boulevard an increasing number of bus benches with ad- vertising have appeared; the Temple City. Municipal Code provides for a permit for the placing, installation and maintenance of bus benches,. however, City Council established a policy in January, 1967 for the downtown business area to terminate permits and approved a1 style of benches which were provided by a local service organization. Councilman Tyrell moved to extend City policy set in January, .1967 to Rosemead Boulevard and authorize staff to advise advertising bench companies . that no permits will be issued and that all existing benches are to be removed by December 31, 1976, seconded by Councilman Merritt and carried. B. Purchase of Radio Equipment City Manager Koski advised ..in adopting the 19 76 -77 budget City Council authorized $5,950 for thepurchase of radio equipment in the high band of radio frequency; staff has solicited quotations from the two major suppliers to governmental agencies in solid state radio equipment; Dick Gridley, radio specialist has reviewed both quotations and feels they are, comparable in quality and acceptability. Councilman Gilbertson moved to approve purchase of Motorola system as quoted and set forth in memo dated October 29, 1976 and on file in the City Clerk's office, seconded by Councilman Tyrell and carried. Revision of Housing Element -City Manager Koski advised the City received a legislative bulletin from the League of California Cities advising revisions to Housing Element Guidelines proposed by the Department of Housing and Community Development will be reviewed and discussed at public hearings at various places during the month of November, which proposal imposes state - mandated programs on all municipalities. Councilman Tyrell moved to oppose the revisions to Housing Element Guidelines as proposed and authorize the Mayor to. :send written comments, seconded by Councilman Gilbertson and carried. D. Joint Powers Agreement - West San Gabriel Valley Juvenile Diversion Project City Attorney Martin advised the City of San Marino became a full and complete participant in subject authority effective November 1, 1976, requiring an amendment to the Joint Powers Agreement. Councilman Tyrell moved to approve the amendment to the Joint Powers Agreement and authorize the Mayor and City Clerk to sign, seconded by Councilman Merritt and carried. E. Councilman Gilbertson directed Council's attention to the deletion of one parking space at the northeast corner of Encinita Avenue and Las Tunas Drive, and expressed concern that the merchants were not advised prior to taking action. Traffic Engineer Envall advised the parking space was deleted: to provide additional visibility for exiting traffic from Encinita Avenue southbound. Mr. Envall stated he-talked with the merchant following the deletion and it was his understanding the space was used by the merchant as an all day parking space. He further stated it has never been his policy to contact merchants prior to this type of action, that the City Manager had talked with him regarding the problems which can result and has instructed him to advise any property owner and /or occupant regarding any proposed changes in traffic regulations that would have an effect on their property and in the future he will observe this policy. Council directed staff to prepare a recommendation with regard to subject parking space to be considered at the November 16, 1976 meeting. F. Councilman Merritt expressed the opinion the City should take another look at their policy regarding green, short -time parking spaces within the downtown business district, stating he felt there were some valid areas for this type of marking. Council directed staff to review the policy and make recommendation at their next meeting to be held November 16, 1976. G. Mayor Greenberg reminded Council and persons in the audience of the Community Forum scheduled for Wednesday, November 10, 1976, 7:30 p.m. at St, Luke's Church. 27 ADJOURNMENT: 1 On motion by Councilman Dennis, seconded by Councilman Merritt, meeting adjourned at 9:15 p.m. Next meeting of the City Council will be held Tuesday, November 16, 1976, 7:30 p.m. in the Council Chamber of the City Hall.
