A SPECIAL ORDINANCE VACATING AN UNUSED PORTION OF ROADWAY LOCATED AT THE CORNER OF SOUTH A AND GARWOOD ROAD
WHEREAS, RDB Concord, LLC has petitioned Common Council of Richmond, Indiana, requesting the vacation of a 35 foot portion of unused roadway located at the corner of South “A” and Garwood
Road; and
WHEREAS, other than the petitioner, the City of Richmond is the only adjoining property owner; and
WHEREAS, said Council, pursuant to Indiana Code 36-7-3-12, conducted a public hearing on said petition November 20, 2000, after publishing legal notice thereof at least ten (10) days
in advance of said hearing as required by statute; and
WHEREAS, the Richmond Advisory Plan Commission, pursuant to Richmond Code 155.04(b), conducted a public hearing on said petition November 16, 2000, after publishing legal notice thereof
at least ten (10) days in advance of said hearing as required by ordinance; and
WHEREAS, it is desirable to vacate said portion of roadway
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that subject to the preservation of easements for existing utilities, and subject to the condition
that if the City requires the reacquisition of the property for public purposes within five (5)years from the date of this ordinance, the Owner shall sell back the property to the City
for the sum of $2,000.00 (provided the Owner is given at least one (1) year prior written notice of the reacquisition), the portion of public way described below is hereby vacated and
RDB Concord, LLC shall acquire ownership of such land heretofore dedicated as a public way as indicated below, to wit:
