HomeMy Public PortalAboutResolution 06-44001 1 1 RESOLUTION NO. 06 -4400 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY UPHOLDING THE DECISION OF THE PLANNING COMMISSION AND DENYING CONDITIONAL USE PERMIT 05 -1638 AND ZONE VARIANCE 05 -1643 TO ALLOW THE ESTABLISHMENT OF A RESTAURANT, WHICH WOULD INCREASE THE ON -SITE PARKING DEFICIENCY OF THE SHOPPING CENTER BY 12 SPACES. THE EXISTING RETAIL USE (VIDEO STORE) REQUIRES FOUR PARKING SPACES PER 1,000 SQUARE FEET OF FLOOR AREA AND THE PROPOSED RESTAURANT USE REQUIRES TEN PARKING SPACES PER 1,000 SQUARE FEET OF FLOOR AREA. THE SUBJECT SITE IS LOCATED IN THE WEST COMMERCIAL (WC) DISTRICT OF THE DOWNTOWN SPECIFIC PLAN AT 9453 LAS TUNAS DRIVE THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. Based upon information contained in the Staff Report to the City Council and information contained in the Planning Commission Staff Report as well as the Planning Commission minutes; and based upon testimony received at a noticed pubic hearing before the Planning Commission on January 10, 2006 and testimony received at a noticed public hearing before the City Council on February 21, 2006, the City Council denies the Conditional Use Permit and Zone Variance based upon the findings contained in Planning Commission Resolution No. 06- 2158PC SECTION 2. Accordingly, Conditional Use Permit 05 -1638 and Zone Variance 05 -1643 are hereby denied. SECTION 3. The City Clerk shall certify to passage and adoption of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED on this 21st day of February, 2006.
