RESOLUTION NO. 06 -4415
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY
UPHOLDING THE PLANNING COMMISSION'S ACTION AND DENYING A REQUEST
FOR ZONE VARIANCES TO ALLOW THE CONSTRUCTION OF A SECOND UNIT
WHILE MAINTAINING THE NON - CONFORMING SIDE YARD SETBACK OF 5 FEET
3 INCHES (INSTEAD OF THE REQUIRED 6 FEET) FOR THE EXISTING MAIN
DWELLING AND TO ALLOW THE APPLICANT TO MAINTAIN AN EXISTING
UNDERSIZED DRIVEWAY OF 12 FEET 6 INCHES (INSTEAD OF THE REQUIRED 15
FEET) FOR A DRIVEWAY OVER 125 FEET IN LENGTH. THE PROPOSED SECOND
UNIT WOULD CONSIST OF 640 SQUARE FEET OF LIVING AREA AND TWO (2)
NEW ATTACHED 2 -CAR GARAGES; ONE OF THE ATTACHED GARAGES WILL
SERVE THE MAIN DWELLING AND THE OTHER ATTACHED GARAGE WILL
SERVE THE PROPOSED NEW SECOND UNIT. THE SUBJECT SITE IS ZONED (R-
1) SINGLE - FAMILY RESIDENTIAL. (ZV 06- 1653)(NGO)(5813 ROWLAND AVENUE)
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE:
SECTION 1. Based upon information contained in the staff report to the City Council and
information contained in the Planning Commission staff report as well as the Planning Commission minutes
of March 28, 2006 and based upon a review of the plans and based upon testimony received at a noticed
public hearing before the Planning Commission on March 28, 2006 and based upon a noticed public hearing
before the City Council on May 16, 2006, the City Council hereby upholds the action of the Planning
Commission and denies the Zone Variance based upon the findings set forth in Planning Commission
Resolution No. 06 -2171 PC.
SECTION 2. Accordingly, Zone Variance 06 -1653 is hereby denied.
