Theis and Anne E. Theis, husband and wife, are the owners of real estate described as: Lots 5, 6, and 7, Block 9 Independence Beach, Hennepin County, Minnesota; and WHEREAS, the three parcels of real estate above described were three separate parcels of record prior to the 16th day of March, 1976; and WHEREAS, the above described owners made application to con- solidate and divide the property as follows: Parcel 1: Lot 5, and the Westerly 30 feet of Lot 6, said Westerly 30 feet measured parallel to and 30 feet Easterly of the boundary line between Lots 5 and 6, all in Block 9, Independence Beach, Henne- pin County. Parcel 2: Lot 7 and Lot 6, except the Westerly 30 feet of Lot 6, said Westerly 30 feet measured parallel to and 30 feet Easterly of the boundary line between Lots 5 and 6, all in Block 9, Independence Beach, Hennepin County. WHEREAS, the proposed parcels are served by public sanitary sewer and water and the owners have requested a fair division of the special assessments heretofore levied; and WHEREAS, none of the described property has previously been the subject of a division/consolidation under this ordinance; and WHEREAS, the proposed division/consolidation will not create a need for additional streets; and WHEREAS, a survey of the property, a sketch of the proposed consolidation, and a concise legal description have been filed as a part of this application; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Medina as follows: 1. That the said division/consolidation is hereby excepted from the Platting Code in accordance with Ordinance No. 159; 2. That the existing special assessments for public improve- ments be divided as follows: Parcel 1: 50% thereof Parcel 2: 50% thereof 3. PROVIDED, HOWEVER, that this Resolution shall be conditioned upon the following requirements: 1. The applicant shall obtain a land division/consolidation for taxing purposes from the Hennepin County Finance Department consistent herewith. 2.
