A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AN EASEMENT
AND A DEED TO DELBERT O. OLIVER AND GLENNA D. OLIVER IN EXCHANGE
FOR THE OLIVER'S EXECUTING AND DELIVERING TO THE CITY FOUR
CERTAIN EASEMENTS ALL OF WHICH PERTAIN TO THE SKAKEL SPRINGS.
WHEREAS, the Governing Body of the City of Moab finds
that it is in the best interest of the health and welfare of the
City of Moab that rights and easements respecting the Skakel
Springs be clearly defined; and
WHEREAS, Delbert O. Oliver and Glenna D. Oliver are
desirous of and willing to grant or to more clearly define
certain easements in exchange for receipt of a certain parcel of
City property described in Exhibit "A" hereto; and
WHEREAS,, the Governing Body hereby finds that the parcel
of City property described as Exhibit "A" is surplus and of
little value to the City, and that the value of the easements
hereby received is equal to or greater than the value of said
parcel and the easement set forth in Exhibit "B"; now therefore
BE IT RESOLVED by the Governing Body of the City of Moab
that the Mayor is authorized and directed to execute and deliver
to Delbert O. Oliver and Glenna D. Oliver the quit -claim deed set
forth in Exhibit "A" hereto and the easement set forth in Exhibit
"B" hereto at such time as Delbert O. Oliver and Glenna O. Oliver
shall execute and deliver unto the City of Moab the easements
which are annexed hereto as Exhibits "C", "D", "E", and "F"
