The Council of Bal Harbour Village met Tuesday, may 25, 1976,
at 9:30 A.M. in the Village Hall.
Present: Messrs. Davis, Logan, Printup, Taplin
Absent: Mr. Beatty
Also present were Fred W. Maley, Village Manager; Betty Carver,
Deputy Village Clerk; and Alan S. Gold, Village Attorney.
On motion of Mr. Davis, seconded by Mr. Tap.lin, and voted, the
minutes of the previous meeting of April 27, 1976, we approved as submitted.

ORDINANCE NO. 187
establishing criteria for building moratoria in Bal Harbour.
After a discussion, and the recommendation that the time limit as stated
in the Ordinance be changed from 120 days to 180 days, a motion was made
by Mr. Davis, seconded by mr. Taplin, and unanimnusiv voted, that the
Ordinance be adopted with the recommended change.
The Clerk was instructed to advertise a Notice of Public Hearing
to be held on Tuesday, June 29, 1976, to consider whether or not a building
moratorium should be imposed on Lots 1 through 16, inclusive, Oceanfront
Section of Bay Harbor; Tracts "C", "D" and "E", Bel Harbour Oceanfront
Additinn; and Tract "A", Oceanfront Section of Bay Harbor in accordance
with the provisions of Ordinance No. 182.

ORDINANCE NO. 183
authorizing the incurrence of indebtedness for renovations to
the Bel Harbour Village Hall. A motion was made by Mr. Davis, seconded
by mr. Taplin, and unanimously voted, that the Ordinance be passed on
first reading.
mr. Gold hand delivered copies of letters which he had sent to
mr. Dan Paul, attorney for the sal Harbour Shops, and to Mr. Fred Maley,
with his recommendations concerning the permanent water hook-up for the
new Saks Fifth Avenue Store, now under construction. Since Mr. Paul is
out of the city, it was moved by Mr. Logan, seconded by Mr. Davis, and
voted that this matter be tabled.
Mr. Printup authorized Mr. Cold and Mr. Maley to approach the
County Manager's office with suggestions to amend the County Coee in order
to more specifically renuire that all those licensed to do work in Dade
County must not only have a copy of their occupational license in the ve-
hicles which they use for conducting their business, but also that their
business name and license number be displayed on the outside of their
vehicles in a readable size.
Mr. Errol Adels of Angelos C. Demetrinu, Land Planners, presented
a preliminary report on his firm's recommendations for changes in the zoning
in the Oceanfront District. It was suggested that Messrs. Maley and Gold
go over the report, and that the final recommendations be presented at a
later daLe for adoption.
Mr. "Red" Langston of M. R. Harrison Construction Co. appeared
to present his company's construction schedule for the proposed new 95th
Street ramps and entrance to the barking deck being constructed on the Bal
Harbour Shops property. Mr. Kevin mcNaughton of the Dade County Traffic
Department was also present, and presented the Council with a letter from
his Departmentcutlining four alternatives to the problem of changing
the Bal Harbour Shops entrance from opposite Byron Avenue to opposite Car-
lyle Avenue. After discussion, it was moved by Mr. Taplin, seconded by Mr.
Davis, that a building permit he issued for the construction of the ramps

only, excluding the new entrance, until the re(:uirements previbusl.y set
nut are met, provided that the Village Attorney receives assurances from
Mr. Whitman and all parties involved that the Village will be held harm-
less should the parking deck not prove usable without the new entrance.
Mr. Maley advised that in this event a Certificate of Occupancy for the
Saks Fifth Avenue Store could not be issued. The motion wan carried 3 to
1, with Mr. Logan voting 'no". Mr. Dan Paul, Attorney for Mr. Whitman,
is to draft a letter for the review of nur Attorney,
It was moved by Mr. Logan, seconded by Mr. Davis, and unanimously
voted, that the Post Office Contract be renewed.
It was moved by for. Davis, seconded by Mr. Taplin, and voted,
that the annual report from the Commission on the Status of Women he accepted
as submitted.
It was moved by Mr. Davis, seconded by Mr. Taplin, and unanimously
voted, that Mr. Beatty be re -appointed as the Bel Harbour representative
to the Dade County League of Cities.
Mr. Printup read two letters he had received from for. Tom Welstead,
President of the Bel Harbour Club, Inc., objecting to the use of Resort
Tax monies for the purpose of advertising in Canadian and German tourist
markets, and any direct or indirect reference to the Ba1 Harbour Club in
the brochures which the Bel Harbour Resort Association has had published.
Mr. Logan stated he would explain to the Bal Harbour Club Board of Directors
the purcose and use of the Resort Tax mnnieo.
Mr, Maley read a letter written by Mr. Karl Hart, Shutts & Bowen,
to Great Lakes Dredge & Dock Company, with reference to final i:ayment to
that firm under our beach dredging contract. The letter said that final
payment would he made in the offices of Mr. Maley at 2:0P P.frl., June 9,
1976. Mr. Maley asked for authorization from the Council to offer Great
Lakes Dredge & Dock Company the final payment in the full amount of the
contract without deducting liquidated damages to which we are otherwise
entitled. This authorization was granted.

aprointing Bel Harbour Village Cnuncil as the Local Government
Planning Agency for Bal Harhnur under the Local Gnvernment Comprehensive
Planning Act. It was moved by Mr. Davis, seconded by Mr. Taplin, and
unanimously voted, that the Ordinance be uansed as read on first reading.
