MINUTES – 21 October 2013 Called to Order: 7:30 PM

7:30 PM Commission Business
• Ms. Recos made a motion to approve the Request for Payment dated 21 October 2013. The
motion was seconded by Ms. Reed and it passed unanimously.
• The Commission signed the following documents:
- Hopkinton DPW, 37 East St - Order of Conditions (188-1524)
- Hopkinton DPW, Elm St - Determination of Applicability (RDA 2013-9)
• Ms. Recos made a motion to approve the draft minutes of 09 September 2013. The motion
was seconded by Mr. Nation and it passed unanimously.
• A discussion was held regarding a request from the DPW, Town-Wide Drainage
Maintenance, RDA 2003-20, to replace an existing 8” culvert between 7 and 9 West Elm
Street with a 12” culvert. The Commission determined the replacement work qualified to be
performed under the Determination.
• Mr. D’Urso and Mr. Griben entered the meeting.
• A discussion was held regarding the Minor Project Exemption request made by Mr. Fowler, 5
Deneen Road (188-1302), for re-grading and paving the inner portion of an existing gravel
driveway. The Commission determined the proposed driveway maintenance work qualified
as an exempt activity.
• A brief discussion was held regarding the Mass Housing Finance Agency’s request for
comments on the Hopkinton Mews Site Plan, Lumber Street. Mr. Nation made a motion to
have Mr. Ingram review the Site Plan and comment on the Commission’s behalf. The motion
was seconded by Mr. D’Urso and it passed unanimously.

• A brief discussion was held regarding the potential CPC funding for Elmwood Farm fencing.
Mr. MacAdam stated there is confusion regarding the location of the Town’s Open Space
land and the abutting private property of 97 and 101 Ash Street. He stated he would like to
request funding to install fencing along the property line to demarcate the Town’s property
bounds. The discussion was continued to later in the meeting.

Notice of Intent
Paul DeSimone, consultant; Paul McCarthy, owner/applicant
Mr. DeSimone provided an overview of the Notice of Intent (NOI) application information and
the site plans dated 25 July 2013, revised through 15 October 2013. He noted that a portion of
the proposed work falls within the Natural Heritage & Endangered Species Program (NHESP)
Estimated Habitats of Rare Wildlife (EHRW). A discussion was held regarding the installation of
a drywell for the discharge of pool water during routine maintenance. Mr. DeSimone stated that
the plan would be amended to include the installation of a drywell for pool maintenance.
A discussion was held regarding the unpermitted expansion of lawn beyond the original limit of
work for the construction of the house (188-660). A discussion was held on considering
alternative layouts to decrease the amount proposed disturbance within the EHRW area and
restoring portions of the EHRW area. Mr. DeSimone noted that the applicant was amenable to
continuing the public hearing to allow the NHESP time to provide comments for review.
The hearing was continued to 04 November 2013.

Scott Goddard, Goddard Consulting; Christopher Nation, applicant
Mr. Goddard provided an overview of the Notice of Intent (NOI) application information and the
site plans dated 16 September 2013. Mr. Goddard explained this is a frontage lot adjacent to the
newly proposed Hunter’s Ridge Subdivision. He stated they have kept the limit of work at the
50-foot buffer zone. Mr. Ingram noted that drywells to infiltrate roof runoff and a permanent
immovable barrier are not shown on the plan. Mr. Goddard stated the applicant is amenable to
both and will amend the plan.
A discussion was held on considering alternative layouts for allowing the house to move closer to
the street, relocating the garage or driveway, and moving the limit of lawn further away from the
50-foot buffer zone. Mr. Nation stated the lot was set up to meet zoning regulations, septic
regulations and be most desirable to a potential buyer.

Notice of Intent

Mr. Goddard provided an overview of the Notice of Intent (NOI) application information and the
site plans dated 27 September 2013. He stated this is the first of approximately 10-12 NOI’s for
the Hunter’s Ridge Subdivision. He stated they have kept all structures outside the 50-foot buffer
zone and have located the lawn at the edge of the 50-foot buffer zone. He noted, in keeping with
the request of the previous filing, he will add a drywell and permanent immovable barrier to the
plan.
The Commission requested the current information regarding cumulative buffer zone impact for
the entire subdivision be tabulated for review. Mr. Goddard told the Commission he expects that
all the future NOI filings for the subdivision will propose lawn up to the 50-foot buffer zone.
The hearing was continued to 04 November 2013.
Mr. Craig Nation returned to the meeting.
8:45 PM Connors, Lot 1, 44 South Mill Street DEP File No. 188-1526

George Connors, applicant
Mr. Connors provided revised site plans dated 15 November 2012 with a final revised date of 08
October 2013. He noted the Planning Board endorsed an ANR plan earlier this evening,
subdividing 9.1 acres of the property and donating it to the Hopkinton Area Land Trust. He noted
the garage has been turned to reduce the amount of disturbed area and plantings to the rear and
side of the lot have been included.
Mr. Nation made a motion to close the hearing and issue an Order of Conditions, subject to the
receipt of electronic plans, with the standard and noted special conditions. The motion was
seconded by Ms. Reed and it passed unanimously.

Notice of Intent-continuation

Group
Mr. Marquedant provided an overview of the revised site plans dated 21 June 2013 with a final
revised date of 07 October 2013. He stated they believe all of BETA Group’s concerns and
outstanding issues have been addressed. A discussion was held regarding the septic system and
the groundwater mounding analysis. Mr. Paradis brought up a potential safety issue regarding the
proximity of the houses to the largest detention basin. It was noted that as designed, the basin is
outside the Commission’s jurisdiction, but if they were allowed to encroach by 20’, it would
alleviate some of the depth and allow it to move away from the houses. It was noted that any
future changes to the project could be reviewed as proposed project changes under the Order of
Conditions.

Mr. D’Urso made a motion to close the hearing and issue an Order of Conditions, subject to the
confirmation from both BETA Group and Provencher Engineering that the septic system
mounding is appropriate, and subject to the standard and noted special conditions. The motion
was seconded by Mr. Nation and it passed unanimously.
9:15 PM Commission Business
• The discussion continued regarding the Elmwood Farm proposal for CPC. Mr. Griben made
a motion to allow Mr. MacAdam to submit a CPC Proposal for fencing at Elmwood Farm.
The motion was seconded by Mr. D’Urso and it passed unanimously.
• Mr. Griben made a motion to appoint Mr. Nation as the Commission’s representative on the
Zoning Advisory Committee. The motion was seconded by Ms. Recos and it passed
unanimously.
• A brief discussion was held regarding refuse and disturbance on a vacant lot on Singletary
Lane owned by Prime Properties. Mr. MacAdam will attempt to contact the property owner.
• A brief discussion was held regarding the stream which flows underneath Fruit Street, near
the Town Wells, that was recently dredged and had trees and brush cut. Mr. MacAdam stated
the Town gave permission for the Central Massachusetts Mosquito Control Project
(CMMCP) to access Town property and perform stream maintenance work to maintain flow.
The Commission determined to have Mr. MacAdam review the CMMCP proposed scale of
work within the stream.
