Subject: Zoning Ordinance Amendment
Attached to this memorandum is a proposed amendment to the Zoning Ordinance for first
reading before the Council. This proposal would amend sections 5.01 and 5.03 to make the
principle use of a parking lot for gain of 50 or more spaces permitted by special permit.
This proposed amendment will allow for careful consideration of the broad community
interests along with appropriate comprehensive planning.
This amendment, after tonight's first reading, will then be forwarded to the Planning Board
for a public hearing in accordance with section 9.20-9.22 of the Zoning Ordinance.
Thereafter, a recommendation will be forwarded by the Planning Board to the Honorable
Town Council for public hearing and final action.

PROPOSED AMENDMENTS TO THE ZONING ORDINANCE:
AMEND SECTION 5.01.3 (C), TABLE OF USE REGULATIONS, COMMERCIAL
PARKING, PARKING LOT FOR GAIN, by ADDING THE FOLLOWING:
ADD New Note (10) to existing "Y" in the NB, LB, CB, 1-1, 1-2, 1-3, and PSCD Zoning
Districts.
So as to read: Y (10)
AMEND SECTION 5.03, NOTES TO TABLE OF USE REGULATIONS
by ADDING New Note (10) as follows:
(10) A parking lot for gain, as a principle use, and for more than 50 parking spaces,
shall only be permitted by Special Permit in accordance with Section 9.05.
