HomeMy Public PortalAbout2010.014 (01-05-10)r RESOLUTION NO. 2010.014 A RESOLUTION: OF THE CITY COUNCIL OF THE CITY OF LYNWOOD TO 3 APPROVE A'N EXTENDED AGREEMENT WITH GANNETT fLEMING TO CONDUCT A DATA GAP INVESTIGATION FOR SOUTHEAST 105 FREEWAY & LONG BEACH BOULEVARD WHEREAS, the City of Lynwood approved the Long Beach Specific Plan to encourage development along its major commercial corridor; and WHEREAS, a major disincentive to development along this corridor is the ,potential existence of hazardous substances and petroleum contamination at various locations along this corridor; and WHEREAS, the :source. of the contamination for the Southeast 105 Freeway &` .Long Beach ..Boulevard .is located at 11600 Long Beach Blvd.; and WHEREAS, the owner of 11600 Long Beach Boulevard has .received several Cleanup and Abatement Orders; and WHEREAS, there is a need to do additional investigation of the contamination ,along the Lynwood Springs Development area to acquire a remedial action .plan and appropriately remediate the contamination known to exist in the area; and WHEREAS, the City of ;Lynwood distributed a Request for Proposals .and acquired four qualified responses; and- WHEREAS, the City of Lynwood evaluated the Responses after a full interview 'and determined that Gannett Fleming submitted a proposal which met the .requirements of the Request for Proposals at a reasonable cost; and WHEREAS, the City of Lynwood determined that the experience of Gannett Fleming would .assist the City in acquiring the required Remedial Action Plan in an expeditious and appropriate manner; and ~_ WHEREAS, Gannett Fleming acquired the necessary written releases from .the Responsible Parties to ensure a thorough and complete data gap investigation; and WHEREAS, the City did not authorize the Data Gap Investigation work to go forward until after.. the response date for the Polanco Act +Oletters had .expired so that the costs of such assessment and remediation could be ,borne 'by the Responsible Party; and WHEREAS, the 'contract with Gannett Fleming had expired in the interim. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ~LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. Authorize the City Manager or his designee to take necessary steps, including the execution of an extended agreement with- Gannett Fleming in a foam subject to approval of the City Attorney to undertake a data gap investigation at the Lynwood Springs site. Section 2. This Resolution shall become effective immediately upon its adoption. PASSED, APPROVED, and ADOPTED this 6th day of January,2010. a~'~J ~ Maria T.
