ATTEST: 1 ,'' S i•t_ Village Clerk June 29, 1976 July 13, 197F The Council of Bel Harbour Village; met in special session, Tuesday, July 13, 1976 at 10:00 A. M. to consider an application for a building permit by 831 Harbour Shops to cnnetruct ramps for their parking deck, Present: Messrs. Beatty, Davis, Logan, Printup and Taplin Also present were Fred W. Maley, Village Manager; Mary T. Wetterer, Village Clerk; and Alan Gold, Village Attorney. Mr. Stanley Whitman reviewed the status of the parking lot entrances, including reports from various governmental agencies, and traffic studies on ingress and egress along 96th street to the Bel. Harbour Shops and to Bel Bay Drive. Mr. Logan questioned the Indemnification Agreement not being signed by Saks Fifth Avenue as well as Bel Harbour Shops, Mr. Paul, attorney for Bel Harbour Shops, said that Bal Harbour Shops is the landlord and is responsible for parking, and that the Kimley-Horn report says that the ramps can be used without relocating the entrance. Mr. Gold said that under the terms of the motion at the May meet- ing, Saks Fifth Avenue should have joined in the Agreement, but that Mr. Oau1 told him this was not possible. However, it is understood that a Certificate of Dccupangy would not be issued until all the conditions set forth on December lath were met. He suggested that the Bal Harbour Shops cruLd post a bond against a suit by Saks Fifth Avenue if the council wished. .July 13, 1976 . j. Mr. Welstead, president of the Bal Harhour Club, objected to the bad traffic conditions at 96th Street and Bei Bay Drive, through which the Club members leave the south end of the Village. He also soid he believed that to move the traffic signal west to Carlyle Avenue would make matters worse, and that a light is needed at this intnreection. Mr. Bruno, of 50 Park Drive Apartments, said the owners of the apartments held a meeting and asked that the Village not issue a permit for the new entrance to the Shops until a new light is installed at 96th Street and Bal Bay Drive. Mr. James Yarborough of Harland Batholomew and Associates explained the proposed Dade County plan for widen.ine 96th Street which was scheduled to be completed by 1982. mr. Gold advised the Council that the Village could be under jeopardy if we do not issue a Certificate nf Occupancy to Saks when the store is completed. He suggested that a bond be put up by Ba1 Harhour Shops or a financial statement filed with the Village showing sufficient assets so that if a suit is brought, the Village woulc be protected. It was moved by mr. Beatty, seconded by Mr. Taplin, that a build- ing permit be issued for construction of the ramps only, excluding the new entrance, until the requirements previously set out have been met, provided, that the Village Attorney receives assurances from mr. Whitman, in case any suit is brought against us by any concerned earty, that the Village would be held harmless, if the parking ramps do not prove usable withnut the now proposed entrance. Mr. Taplin withdrew his second so that an addition could be made to the motion by mr. Davis as follows: that the attorney secure fr,m the principal, mr. Whitman, cefr„lete assurance for the village that there will be complete reimbbrsement at any point in any .legal action by any of the parties involved in the shopping center in lease arrangements with the Bel Harbour Shoes. The amended motion was then seconded by mr. Taplin. Mr. Gold advised Mr. Whitman that he would accept a financial statement nr n sufficient bond under the motion, which mr. Whitman agreed to do. The mntion was carried by Messrs. Beatty, Davis, Printup and Taplin, voting "yes"; mr. Loden, "no". There being nn further business on motion nf mr.
