LYNWOOD OVERTURNING THE PLANNING COMMISSION'S DECISION; AND ` APPROVING CONDITIONAL USE PERMIT NO. 98-17 FOR THE OPERATION OF AN AUTO CENTER "AT 3516 E. IMPERIAL " HIGHWAY, LYNWOOD, ,CA, IN THE C-2 ZONE. • • WHEREAS, the Lynwood Planning Commission, pursuant to law, on November 10, 1998 conducted a public hearing on tfie subject application; and • • WHEREAS, the Planning Commission considered all pertinent testimony offered at the public hearing and denied the subject application; and ~. WHEREAS, `the Director. of the Community Development Department has determined that the proposal is Categorically Exempt pursuant to section 15301 of the ... requirements for the California Environmental Quality Act; and . WHEREAS; the City .Council, pursuant to law, .ori December 15, 199, 8 conducted a public hearing on the appeal of the Planning Commissions decision; therefore Section 1. The City Council hereby finds and determines as follows: A. .The granting of the proposed conditional use permit will not adversely affect ~1. the comprehensive General Plan.. ~ . • B. •The proposed location of he conditional• use is in accord with the objectives • .4 "of the Zoning. Ordinance and the .purpose of the zone in which the site in - located., . C. The proposed conditional. use will comply with each of the applicable provisions of the Zoning Ordinance, except for approved variances. • Section 2. The City Council of the City of Lynwood, hereby grants the Conditional Use Permit No. CUP 98-17 approving the Auto Center at 3516 E. Imperial Highway, which includes a used °auto... sales lot, auto xepair. and body shop, subject to the following conditions, restrictions and limitations set forth as follows: ~ - • f-~--•1 - CONDITIONS OF APPROVAL . The following Conditions shall apply at all times while the Conditional Use Permit is in .effect: Communi , Development 1. Any. subsequent modification of the subject site or structures thereon, shall be first reported to the Community Development Department, Planning Division for review. 3.' ~ The applicant, or his ,representative,. shall sign. a Statement of Acceptance stating he/she .has .read, understands,. and. -agrees to the conditions stated herein before . issuance of building. permits or a business license. for said application. 4.... The applicant shall meet the requirements of all other city departments. 5. The conditional use must become operational within 180 days of the issuance ofthis approval. The Conditional Use Permit shall become invalid 180 days from the date of approval. Orie extension maybe granted if the extension is requested prior to the end of the valid period, at the sole and absolute discretion of the Community Development Director. 6. Automotive uses shall provide adequate, vehicular circulation so as not to create traffic problems. ' 7. - All structures shall be sufficiently soundproofed to prevent annoyance or detriment to . surrounding properties. 8. All repair and body work shall be completed within a fully.enclosed structure. There shall be no outdoor operations.or work...All vehicles awaiting repair or removal from the.. site shall be effectively screened from view from any public street or highway, as indicated on the site plan, or adjoining property by a six foot (6') high wall or fence, as indicated on the site plan. A landscaping I plan shall be submitted to the Community .Development Department. An automatic ' ' : sprinkler system shall be installed in all landscaped areas to ensure proper maintenance and shall be included in the landscaping plan. 10. All activities as described herein shall be confined to the hours between seven o'clock (7:00) A.M. and nine o'clock (9:00) P.M. daily. .11: Any artificial light shall be designed to reflect away from adjoining properties. 12. No damaged or wrecked vehicles shall be stored on site. 13. Adequate off-street parking shall be provided in accordance with the provisions of the . Zoning .Ordinance. 14. Refuse Storage Areas; Garbage or trash receptacles ,shall be metal or plastic containers equipped with overlapping, fly-tight lids, or other comparable containers, as may be approved by the Director of Community Development.. Such containers shall be stored in an area that is .enclosed on three (3) sides by a solid masonry and equipped with a latched gate. The wall should be at least six feet (6') in height. 15: The parking lot/sales lot: shall is to`be resurfaced prior to f nal approval to open. The required off-street parking shall be permanently striped and subject to review by the Planning Division. ,. ~~ 16. Reconstruct damaged sidewalk along Imperial Highway. - . 18. Close existing drive approach and construct sidewalk per APWA, standards on Imperial Highway. , 19. Install two 24" box street trees per-APWA standards along Imperial Highway. °,t ~ 20. Construct tree well covers per APWA standards for existing and proposedstreet trees. ° ~ ~ Fire Department ~ + . 21. Provide address to location. A minimum of six inch numbers are required to be ~ . located in a conspicuous place, easily seen from the street. l 22. Remove all trash and debris from property. 23, Provide approved fire sprinkler protection in.spray booth. 24. ' All combustible oily rags shall be stored. in metal containers equipped with tight fitting cover. ' 25. Provide approved~parts cleaner. „ ~~ - 26. Fire extinguisher requirement-shall be determined by field inspection. ' Section 3.
