Isham and Steven R. Isham are the owners of real estate described on Exhibit A and attached hereto and made a part hereof by reference; and WHEREAS, the said real estate was a separate parcel of record prior to the 16th day of March, 1976; and WHEREAS, the above described owners have made application to divide the property as follows: ` Parcel 1: That part of the Southwest quarter vZ -#(1-(-k c- of the Northwest quarter lying West of the East 130 feet thereof, Southwesterly of a line drawn �a�. C CNC .C.V. parallel with and 235 feet Southwesterly, measured at eight angles, from the Southwesterly right-of- way line of the Minneapolis, St. Paul & Sault Ste. Marie Railroad, and East of a line drawn North parallel with the East line of said Southwest quarter of the Northwest quarter from a point on `the South line of said Southwest quarter of the Northwest quarter distant 393 feet West from the Southeast corner of said Southwest quarter of the Northwest quarter, all in Section 12, Township 113 North, Range 23 West of the 5th Principal Meridian. Parcel 2: That part of the Northwest quarter of the Southwest quarter lying West of the East 130 feet thereof_, East of a line drawn South parallel with the East line of said Northwest quarter of the Southwest quarter from a point on -the North line of said Northwest quarter of the Southwest quarter distant 393 feet West from the Northeast corner of said Northwest quarter of the Southwest quarter, and Northerly of the centerline of Rock- ford Road, subject to an easement for road purposes over the Southerly 33 feet thereof, all in Section 12, Township 118 North, Range 23 West of the 5th Principal Meridian. WHEREAS, the proposed parcels are served by public sanitary sewer and water, and all the assessments thereon have been paid; and " .f WHEREAS, none of the described property has previously been the subject of a division under this ordinance; and WHEREAS, the proposed division will not create a need for additional streets; and WHEREAS, a survey of the property, a sketch of the proposed division, and a concise legal description have been filed as a part of this application; NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of Medina that the said division is hereby excepted from the Platting Code in accordance with Ordinance No. 159; PROVIDED, HOWEVER, that this Resolution shall be conditioned upon the following requirements: 1. The applicants shall obtain a land division for taxing purposes from the Hennepin County Finance Department consistent herewith. 2. The applicants shall pay an administrative fee to the City of Medina in the amount of $150.00. 3. The applicants shall submit the legal description for the property as it presently exists, said legal description to be attached hereto as Exhibit A. 4. The applicants shall supply the names of their spouses, if any, together with a consent signed by any such spouse to this application for land division.
